FOIA-2023- Schwartz, - It was reported in 2015 that the NRCs 11/17/2022 000022 Greg Inspector General was investigating whether the Commission made a mistake when it allowed PG&E to change earthquake safety standards at the Diablo Canyon nuclear plant, located in San Luis Obispo County, Calif., without holding public hearings. It was also reported that the NRC IGs office was additionally looking into whether NRC and PG&E colluded to dismiss safety concerns by Diablo Canyon's former safety inspector Michael Peck. I seek any and all records related to these investigations and the final report(s).

Items of Interest Week Ending November 18, 2022 NRC Holds Public Meeting on the Limerick Digital Instrumentation and Control License Amendment Request On November 10, 2022, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting (Agencywide Documents Access and Management System Accession No. ML22311A506) with Constellation to discuss the ongoing acceptance review of the Limerick digital instrumentation and control license amendment request. The NRC staff discussed potential acceptance issues with Constellation. The purpose of the meeting was for the NRC staff to gain a better understanding (e.g., use of referenced reports) of how the licensee addressed each potential issue in the license amendment request. The NRC staff informed Constellation that no decision has been made on whether the potential acceptance issues need to be addressed by Constellation to make the request sufficient for review.
NRC Transmits SHINE Safety Evaluation Report to the Advisory Committee on Reactor Safeguards On November 10, 2022, the NRR staff transmitted the SHINE Medical Technologies, LLC, draft operating license safety evaluation report to the Advisory Committee on Reactor Safeguards to support a Full Committee meeting scheduled for November 29, 2022.
NRC Issues Interim Staff Guidance On November 14, 2022, the NRC staff published a Federal Register notice issuing Final Interim Staff Guidance (ISG) DNRL-ISG-2022-01, "Safety Review of Light-Water Power-Reactor Construction Permit Application, (87 FR 68202). The ISG clarifies existing guidance used to assist the staff in determining whether an application to construct a light-water power-reactor facility meets the minimum requirements for issuance of a construction permit.
NRC Hosts Public Meeting on the Reactor Oversight Process On November 17, 2022, the NRC staff hosted a public meeting related to the Reactor Oversight Process (ROP) to discuss: the NRCs self-assessment review of Significance Determination Process timeliness (ML22311A546) and the Nuclear Energy Institutes comments on initial recommendations identified as part of that review; a general status of ROP Enhancement activities, including a detailed presentation of inspection sample size changes as a result of ROP Enhancement since 2019 (ML22308A147); the NRCs effectiveness review of safety culture (ML22308A138); and an update on rulemaking related to Title 10 of the Code of Federal Regulations 50.72 Nonemergency Reporting Requirements ML22318A233). Attendees included the industrys Reactor Oversight Process Task Force, NextEra, Entergy, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for January 18, 2023.
NRC Hosts Public Meeting on High Energy Arcing Faults On November 16, 2022, the NRC conducted a public meeting with industry representatives to exchange information and risk insights obtained from the review of operating experience and the associated updated High Energy Arcing Faults (HEAF) PRA methodology (ML22299A182).
Specifically, the NRC staff discussed the regulatory responses and follow-up actions resulting from the staffs Integrated Risk-Informed Decisionmaking (LIC-504) analysis. The staffs meeting objective of sharing information with external stakeholders related to HEAF events that could further enhance the response of licensees to similar events was achieved. The meeting was well attended and had an interactive panel session that provided a positive exchange of information.

Office of Nuclear Material Safety and Safeguards (NMSS)
Items of Interest Week Ending November 18, 2022 DOE cost-shared award to American Centrifuge Operating On November 10, 2022, the U.S. Department of Energy announced an approximately $150 million cost-shared award to American Centrifuge Operating (ACO) to produce high-assay low-enriched uranium (HALEU) at its U.S. Nuclear Regulatory Commission (NRC)-licensed American Centrifuge Plant in Piketon Ohio. The award includes a $30 million cost share during the first year in which ACO will complete installing the 16 operating centrifuge cascade and produce by December 31, 2024, 20 kg of HALEU enriched to 19.75 percent U-235 by weight (Phase I). Beyond that date, and subject to appropriations, ACO will continue producing HALEU at a rate of 900 kg/year (Phase II). ACO has indicated to the NRC staff that it will be submitting, in November 2022, an amendment request for Phase I to extend the authorization for the HALEU demonstration program from its current expiration date of November 30, 2022, to December 31, 2023.
Council on Radionuclides and Radiopharmaceuticals, Inc. Transportation Committee Meeting On November 15, 2022, NMSS staff participated in a meeting held by the Council on Radionuclides and Radiopharmaceuticals, Inc. Transportation Committee and provided a status update on the 10 CFR Part 71 proposed rule, Harmonization of Transportation Safety Requirements with IAEA Standards, (87 FR 50788; September 12, 2022). The Part 71 rule is being developed in collaboration with the U.S. Department of Transportation (DOT) and seeks to harmonize U.S. domestic requirements for the transportation of radioactive material with the IAEA international specific safety requirements and changes to the DOT regulations and make NRC-initiated changes.
Public Meeting on Draft Environmental Impact Statement for the Kairos Hermes Reactor On November 16, 2022, NRC staff held a hybrid public meeting in Oak Ridge, TN, to discuss the Draft Environmental Impact Statement for the Kairos Hermes test reactor and to solicit public comments. Approximately 50 people attended the meeting in person and 15 participated via Teams. Also on November 16, 2022, staff met with 13 local officials and representatives from state regulatory agencies and answered questions regarding the Kairos project, the NRCs review process, and other projects anticipated for the Oak Ridge area.
Fourth Meeting of the New Mexico State Radioactive and Hazardous Materials Committee On November 14, 2022, NMSS staff presented at the Fourth Meeting of the New Mexico State Radioactive and Hazardous Materials Committee in Santa Fe, NM, as requested by the State of NM. This presentation was part of a panel presenting to the State legislative committee on Uranium Mining Legacy Cleanup. The panel included three presentations from State Directors on the status of uranium mine cleanups. The State passed Bill 0164 in the 2022 session that provided funding for additional State staff positions for uranium mine cleanup and coordination with the Federal Government on uranium mill cleanups.
Notice of Intent To Conduct Scoping Process and Prepare Supplement To Draft Environmental Impact Statement Virginia Electric and Power Company North Anna Power, Units 1 and 2 [Docket Nos. 50-338 and 50-339; NRC-2020-0201]
On November 15, 2022, the NRC published a notice in the Federal Register (87 FR 68522) announcing the receipt of an Environmental Report, Supplement 1, from Virginia Electric and Power Company (Dominion, the applicant), related to Dominions application for subsequent NOVEMBER 28, 2022 ENCLOSURE D
license renewal (SLR) of North Anna Power Station Units 1 and 2 (North Anna). The NRC staff will prepare a supplement to its draft supplemental environmental impact statement (DSEIS) for North Anna SLR, i.e., NUREG-1437, Supplement 7, Second Renewal, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 7, Second Renewal, Regarding Subsequent License Renewal for North Anna Power Station Units 1 and 2, Draft Report (August 2021). The NRC will conduct a limited scoping process to gather information necessary to prepare a supplement to its DSEIS to evaluate the environmental impacts of SLR of the operating licenses for North Anna. The NRC is seeking public comment by December 15, 2022, on the proper scope of the site-specific environmental impact statement supplement to be prepared for this action.
Public Meeting with NEI to discuss 22-01 On November 16, 2022, NMSS held a hybrid public meeting with the Nuclear Energy Institute (NEI) to discuss NEI 22-01, License Termination Process. NEI plans to submit this document for NRC review in mid-December 2022 under a fee waiver request. NEI 22-01 provides guidance to decommissioning commercial nuclear power plants on all aspects of decommissioning such as preparing license termination plans and final status survey reports based on existing NRC guidance. It is informed by lessons learned from previous industry experience and provides advice on interactions with other Federal and State organizations during decommissioning. NEI presented information on the contents of the planned submittal and requested preliminary feedback on the scope of the document from NRC staff.
Approximately 25 representatives from industry, State government, and NRC participated in the meeting.
American Nuclear Society Winter Meeting On November 16, 2022, NMSS staff participated in two panels at the American Nuclear Society Winter Meeting held in Phoenix, AZ. In one of the panels, staff from NMSSs Division of Decommissioning, Uranium Recovery, and Waste Programs was an invited speaker along with representatives from Department of Energy Legacy Management, State of New Mexico, and ProPublica. The second panel examined the status of the comprehensive U.S. government interagency program to address the impacts of uranium contamination in the Southwest.
Approximately 40 individuals attended the panel.
National Academies of Sciences Public Meeting On November 16, 2022, NMSS staff participated in a virtual public meeting with the National Academies of Sciences, Engineering and Medicine study group for Assessing and Improving Strategies for Preventing, Countering, and Responding to Weapons of Mass Destruction Terrorism. Staff provided an invited presentation on U.S. Foreign Obligations on Exported Nuclear Material, and responded to questions along with staff from the Office of Nuclear Security and Incident Response and the Office of International Programs.
Miscellaneous Corrections: Final Rule; 10 CFR Parts 20, 35, 50, 51, 52, 72, 73, 110 and 150 [NRC-2022-0100; RIN 3150-AK81]
On November 14, 2022, the NRC published a notice in the Federal Register (87 FR 68028) amending its regulations to make miscellaneous corrections. These changes include correcting typographical errors, removing obsolete language, inserting missing language, and updating the telephone number for the NRC's Region IV office. This final rule is effective on December 14, 2022.
