Items of Interest Week Ending JANUARY 8, 2021 NRC Hosted Public Webinar for Advanced Reactors Rulemaking On January 7, 2021, NRC staff held a public webinar (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20353A093) to discuss preliminary proposed rule language for the technology-inclusive Title 10 of the Code of Federal Regulations (10 CFR)

Part 53 advanced reactor rulemaking, Subpart C, Requirements for Design and Analysis, and the facility safety program section of Subpart F, Requirements for Operation. Stakeholders also provided feedback on preliminary rule language presented in November (ADAMS Accession No. ML20322A001) on 10 CFR Part 53, Subpart B, Technology-Inclusive Safety Requirements. Over 100 stakeholders attended the meeting, including representatives from the Nuclear Energy Institute, United States Nuclear Industry Council, Union of Concerned Scientists, and advanced reactor developers. Stakeholders provided varying perspectives on the preliminary rule language which the staff will consider as it continues to develop the rule.

The next step will be to release preliminary proposed rule language related to siting requirements (10 CFR Part 53, Subpart D) to support a planned public meeting in February 2021.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. On January 7, 2021, the NRC published a notice in the Federal Register (86 FR 1022) denying two related petitions for rulemaking (PRMs), PRM-50-93 and PRM-50-95, submitted by Mark Edward Leyse. The petitioner requested that the NRC amend its regulations for the domestic licensing of production and utilization facilities. The NRC is denying these petitions because existing NRC regulations provide reasonable assurance of adequate protection of public health and safety. The petitioner did not present sufficient new information or arguments to support the requested changes. The dockets for the petitions for rulemaking, PRM-50-93 and PRM-50-95, are closed on January 7, 2021.
