DPR-23 RESPONSE TO NRC STAFF GUIDANCE FOR USE IN ACHIEVING SATISFACTORY COMPLIANCE WITH FEBRUARY 25, 2002, ORDER SECTION B.5.b Ladies and Gentlemen:

On February 25, 2005, the NRC issued a letter ("The Letter") on the subject of "NRC Staff Guidance for Use in Achieving Satisfactory Compliance with February 25, 2002, Order Section B.5.b." In The Letter, the NRC requested that Carolina Power & Light Company, also known as Progress Energy Carolinas, Inc. (PEC), provide, by May 31, 2005, a detailed response describing the site-specific plans and schedule for the H. B. Robinson Steam Electric Plant (HBRSEP), Unit No. 2, to address the various considerations enclosed with The Letter. The Letter also indicated that the NRC expects all planned mitigating strategies described in the response to be implemented by August 31, 2005.

In response to The Letter, PEC provides, as Attachment I to this letter, the plans to address the various considerations in Enclosure 2, Attachments A and B, of The Letter, for HBRSEP, Unit No. 2. These plans are based on using existing or readily available resources for effective implementation of the expectations listed in Enclosure 2, Attachment B, of The Letter.

Also in response to The Letter, PEC provides, as Attachment II to this letter, a schedule for implementation of those mitigating strategies for which work is in progress. PEC considers implementation, by August 31, 2005, of those mitigating strategies listed on Attachment II to be a regulatory commitment.
