DPR-23 WITHDRAWAL OF THE REQUEST FOR RELAXATION FROM THE ORDER FOR ESTABLISHING INTERIM INSPECTION REQUIREMENTS FOR REACTOR PRESSURE-VESSEL-HEADS AT PRESSURIZED WATER REACTORS (EA-03-009)

Dear Mr. Dyer:

By letter dated August 15, 2003, Progress Energy Carolinas, Inc. (PEC), formerly known as Carolina Power and Light Company, provided a request for relaxation of the subject Order in accordance with the provision of the Order that states the Director, Office of Nuclear Reactor Regulation, may, in writing, relax or rescind any of the conditions of the Order upon demonstration by the licensee of good cause. Supplemental information in support of the August 15, 2003, relaxation request ,was provided by letter dated November 21, 2003, and a revision to the request was provided by letter dated December 22, 2003.

In a telephone conference with NRC Nuclear Reactor Regulation personnel on Friday, January 16, 2004, H. B. Robinson Steam Electric Plant (HBRSEP), Unit No. 2, representatives were informed that for various reasons the relaxation request would not be approved. Therefore; th'e' aforementioned request for relaxation is hereby withdrawn from consideration. Another relaxation request may be submitted in the near future, which would include only the relaxations deemed necessary for the refueling outage that starts in April 2004.
