ANALYSIS OF VISTRAS UPDATED DECOMMISSIONING FUNDING PLANS FOR THE BEAVER VALLEY, DAVIS BESSIE, PERRY, AND COMANCHE PEAK INDEPENDENT SPENT FUEL STORAGE INSTALLATIONS
By letter dated December 17, 2024 (ML24352A204), Vistra Operations Company LLC (Vistra) submitted an updated decommissioning funding plan (DFP) for Beaver Valley Power Station Units 1 and 2, Davis-Besse Nuclear Power Station Unit 1, and the Perry Nuclear Power Plant Independent Spent Fuel Storage Installations (ISFSI), for U.S. Nuclear Regulatory Commission (NRC) staff review. By letter dated March 24, 2025 (ML25083A303), Vistra submitted an updated DFP for the Comanche Peak Nuclear Power Plant ISFSI for NRC staff review. Pursuant to Title 10 of the Code of Federal Regulations (CFR) 72.30(c), at the time of license renewal and at intervals not to exceed three years, the initial DFP required to be submitted by 10 CFR 72.30(b) must be resubmitted with adjustments as necessary to account for changes in costs and the extent of contamination in an updated DFP. The updated DFP must update the information submitted with the original or prior approved plan. In addition, the updated DFP must also specifically consider the effect of the following events on decommissioning costs, as required by 10 CFR 72.30(c)(1)-(4): (1) spills of radioactive material producing additional residual radioactivity in onsite subsurface material, (2) facility modifications, (3) changes in authorized possession limits, and (4) actual remediation costs that exceed the previous cost estimate.
The NRC staff reviewed Vistras 2024 and 2025 updated DFPs, including the updated decommissioning cost estimate (DCE) and the method of assuring funds for decommissioning, in accordance with 10 CFR 72.30(c) and NUREG-1757, Vol. 3, Rev. 1, Consolidated Decommissioning Guidance. Based on the review, the NRC staff finds that the updated DFPs contains the information required by 10 CFR 72.30(c) and that Vistra has provided reasonable assurance by which funds will be available to decommission the ISFSI
at Beaver Valley, Davis-Besse, Perry, and Comanche Peak. Therefore, the NRC staff finds that the DCEs adequately estimated the cost, at this time, to carry out required ISFSI decommissioning activities prior to license termination, and that the DCEs are reasonable.
