AMENDMENT 24 - APPROVAL OF REQUEST TO EXTEND TEMPORARY LICENSE CONDITION FOR AIR SAMPLING (ENTERPRISE PROJECT IDENTIFIER L-2025-LLA-0143)

Dear Danielle Rogers:

This refers to letter 21G-25-0127, dated August 26, 2025 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML25246A659), in which Nuclear Fuel Services, Inc. (NFS) submitted a request for an extension to a temporary license condition for special nuclear material (SNM) license number SNM-124.

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the request.

The NRC has determined that the requested extension to safety condition S-10 of SNM-124 is acceptable, and issuance of this license amendment will not significantly impact the public health and safety and the environment, will not be inimical to the common defense and security, and will not endanger life or property or the common defense and security.

Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 70, Materials License SNM-124 is hereby amended to revise Condition S-10 as follows:

Notwithstanding the commitments in Chapter 9 of the SNM-124 license application, NFS shall implement compensatory measures, as stated in the letter dated October 9, 2024, for the air sampling location that was significantly impacted by the 2024 weather event.

In accordance with Chapter 9 of the license application, NFS has documented this condition in the Corrective Action Program. This condition shall remain in effect until the earlier of October 1, 2026, or upon restoration of normal conditions pertaining to commercial power and public vehicle access near the original air sampling location. transmitted herewith contains security related information. When separated from the sensitive conditions in Enclosure 2, this document and Enclosures 1 and 3 are decontrolled.

OFFICIAL USE ONLY SECURITY-RELATED INFORMATION All other license conditions shall remain unchanged. Enclosures 1 and 2 to this letter provide the amended Materials License SNM-124. The NRC staffs review is documented in a safety evaluation report, which is Enclosure 3 to this letter. This letter concludes action on this submittal, and Enterprise Project Identifier L-2025-LLA-0143 is considered CLOSED. contains sensitive security-related information. Accordingly, it is marked as Official Use Only, and is withheld from public disclosure. When separated from the sensitive enclosure, this letter, Enclosure 1, and Enclosure 3 are decontrolled and publicly available, in accordance with 10 CFR 2.390 of the NRCs "Agency Rules of Practice and Procedure."

In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and Enclosures 1 and 3 will be available for public inspection in the NRC Public Document Room (PDR) or electronically from the publicly available records component of ADAMS. The PDR is currently open Monday-Friday by appointment only.
