LETTER TO M. KELLER, HYBRID POWER RE: COMMENT PERIOD EXTENSION REQUEST FOR THE PROPOSED RULEMAKING ON THE RISK-INFORMED, TECHNOLOGY-INCLUSIVE REGULATORY FRAMEWORK FOR ADVANCED REACTORS,
Dear Michael F. Keller:
On behalf of the U.S. Nuclear Regulatory Commission (NRC) staff, I would like to thank you for your continued engagement on our approach to develop the Risk-Informed, Technology-Inclusive Regulatory Framework for Advanced Reactors (the Part 53 rule) and for your letters dated January 10, 2025 (Agencywide Documents Access and Management System Accession No. ML25027A422), January 21, 2025 (ML25023A239), and February 10, 2025 (ML25042A549),
regarding the public comment period for the Part 53 proposed rule.
In response to your requests for additional time to review and comment on the Part 53 proposed rule, the NRC staff has considered your request and has decided not to further extend the formal public comment period for its Part 53 proposed rulemaking.
On November 22, 2024, the NRC extended the original Part 53 public comment period of 60 days by an additional 60 days (see Federal Register notice 89 FR 92609) to February 28, 2025 to allow more time for members of the public to develop and submit their comments and for the NRC staff to engage with stakeholders on the proposed rule language. The staff also held 2 public meetings on November 19-21, 2024 (ML24311A084), and January 8, 2025 (ML25007A095), to discuss the proposed rule language and facilitate stakeholder feedback through the formal comment period. Consequently, the public comment period for the Part 53 rule is 120 days, which is appropriate for this rulemaking. Additionally, the Nuclear Energy Innovation and Modernization Act requires the NRC to issue the final Part 53 rule by December 2027, and the NRC is committed to meeting this congressionally mandated deadline. Please note that comments received after February 28, 2025, will be considered if it is practical to do so, but the NRC is able to ensure consideration only for comments received before this date.
