US SFR Owner, LLC - KEMMERER UNIT 1 ENVIRONMENTAL REPORT AUDIT PLAN (CAC NO. 001912; EPID NO. L-2024-LNE-0002)

Background:
By letter dated March 28, 2024, TerraPower, LLC (TerraPower), on behalf of its wholly owned subsidiary US SFR Owner, LLC (USO) submitted an Environmental Report (ER) in support of a construction permit (CP) application for its Kemmerer Unit 1 reactor (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24088A059). By letter dated May 21, 2024, the Nuclear Regulatory Commission (NRC) notified USO of its acceptance of the construction permit application for detailed review (ML24135A109). A notice of the acceptance for docketing was published in the Federal Register on June 4, 2024 (89 FR 47997). The staff is reviewing the information in the ER (ML24088A072) per Title 10 of the Code of Federal Regulations (10 CFR) Part 51. In accordance with 10 CFR 51.20 the staff is preparing an Environmental Impact Statement (EIS) to evaluate the environmental impacts from the proposed action.
In its initial review of data and information within the corresponding context of the ER, the staff is identifying information needs that would promote a better understanding of the detailed analysis and bases underlying the construction permit application. This environmental audit will provide the NRC staff an opportunity to discuss these items with the applicant subject matter experts, staff and contractors. During the audit, the staff will discuss a wide range of environmental matters related to land use, ground and surface water, terrestrial and aquatic ecology, human health, postulated accidents, radiological and non-radiological waste, cultural resources, fuel cycle, transportation of radioactive material, alternatives to the proposed action, socioeconomics/environmental justice, air quality and noise. The audit will allow the staff to better understand the site, environmental interfaces of the project, and modeling results, to draw appropriate environmental findings. Purpose:
The purpose of NRC staff conducting an environmental audit of the Kemmerer Unit 1 ER is to seek clarification, improve understanding, and to verify information provided in the ER and supporting documentation.
Regulatory Audit Basis:
Requirements for environmental reports supporting construction permits are specified in 10 CFR 51.50, Environmental Reports - construction permit, early site permit or combined license stage.
Regulatory Audit Scope
Audit team members will review documents and other requested information outlined in the information needs list and raised during discussions. The team will focus on information provided by USO in the electronic reading room (eRR) and during meetings and interactions.
This list covers those environmental review areas outlined in the Background section of this audit plan. Specific objectives and topics to be discussed will be identified in subsequent correspondence, such as an email, and dates will be proposed for discussion of the information.
Environmental Review Team
Table 1 includes a list of the NRCs environmental review team assigned to the USO ER review and their role or review area coverage. Additional audit team members will be added, as needed.

Information and Other Material Necessary for the Regulatory Audit
USO should be prepared to provide documents, reports, calculations, computer code verification, and other material, as applicable, supporting the analyses documented in the ER.
The NRC staff may request that USO make these additional materials available on the eRR or during a site visit if one is conducted. Initial information requests and discussion items are identified in the enclosed table. Additional requests will be provided during the remainder of the audit.
Logistics
Entrance Meeting July 30, 2024 Exit Meeting January, 2025 (Tentative)
Audit meetings will take place in a virtual format, using Microsoft Teams, or via other, similar platform. The NRC and USO audit managers will schedule meetings as needed upon USO review of this audit plan. The audit duration is anticipated to be approximately 6 months with activities occurring regularly for some subjects and intermittently for others. Follow up sessions will be scheduled, if needed, until audit closure. If a site visit is needed, review topics will be provided to USO, and mutually agreeable dates will be established.
The audit period may be reduced or extended, depending on the progress made by the NRC staff and USO in addressing audit questions. Additional audit activities may be planned as necessary to support the NRC staffs understanding of information needed to complete the review of the Kemmerer Unit 1 CP application.
To improve the efficiency of the audit, USO and the NRC staff discussed the use of the eRR established by USO that would allow the NRC staff read-only access to the technical information provided by USO. Use of the eRR is acceptable provided that USO establishes measures to limit access to specific NRC staff (e.g., based on NRC email addresses or the use of passwords which will only be assigned to the NRC staff directly involved in the audit on a need-to-know basis), and to make the documents view-only (i.e., prevent NRC staff from saving, copying, downloading, or printing any documents). The conditions associated with the eRR must be maintained throughout the audit process. The NRC audit project managers will provide USO with the names of the NRC staff audit team that will require access to the eRR.
Special Requests
The NRC staff requests that USO ensure that their technical staff are available to answer questions during the audit.
Deliverables
At the completion of the audit, a publicly noticed exit meeting will be held at which time a summary of audit activities and discussions will be presented along with the status of staff information needs identified as part of the audit. In addition, the audit team will issue an audit summary within 90 days after the exit meeting but will strive for a shorter duration. The audit summary will be declared and entered as an official agency record in ADAMS and be made available for public viewing through the publicly available records component of ADAMS.
