ACKNOWLEDGMENT OF WITHDRAWAL OF GE HITACHI NUCLEAR ENERGY LICENSING TOPICAL REPORT NEDC-33934P, REVISION 0, BWRX-300 SAFETY STRATEGY AND SUBMITTAL OF REVISION 1
Dear Ms. Catts:
By letter dated June 21, 2024, you requested withdrawal of the previously submitted Licensing Topical Report (LTR) NEDC-33934P/NEDO-33934P, Revision 0, BWRX-300 Safety Strategy.1 In the same letter, you submitted Revision 1 of NEDC-33934P/NEDO-33934P to supersede the prior submittal in its entirety to address concerns identified during the U.S. Nuclear Regulatory Commission (NRC) staff withholding determination review.
The NRC staff acknowledges your request to withdraw Revision 0 of the LTR and has taken appropriate actions to remove it from the NRC document management system and to prevent inadvertent review and release under an external request.
The NRC staff has reviewed Revision 1 of the LTR and determined that the material is in accordance with the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 2.390. Based on the statements in the affidavit, the NRC staff has determined that the submitted information contains proprietary, commercial information and should be withheld from public disclosure, as noted in enclosure 1. In addition, the NRC staff determined that the changes in Revision 1 of the LTR do not significantly impact the NRC acceptance review issued on April 5, 2024.2 1
