Dear Mr. Shams:

On behalf of the nuclear energy industry, the Nuclear Energy Institute (NEI) 1 is submitting to the U.S.

Nuclear Regulatory Commission (NRC) the attached revision 0 of NEI 24-05, An Approach for Risk-Informed Performance-Based Emergency Planning, fo r endorsement. NEI 24-05 is part of the overall industry, Department of Energy, and NRC Licensing Modernization Project (LMP) program, and extends the work from NEI 18-04, Risk-Informed Performance-Based Technology Inclusive Guidance for Non-Light Water Reactor Licensing Basis Development, by providing a systematic and technology-neutral methodology for the development of emergency plans in accordance with 10 CFR 50.160, Emergency preparedness for small modular reactors, non-light-wat er reactors, and non-power production or utilization facilities. The document was jointly developed by Argonne National Laboratory and NEIs Advanced Reactor Regulatory Task Force.

The guidance in NEI 24-05 establishes an approach that leverages the analyses, outcomes, and insights of the methodology endorsed in Regulatory Guide 1.233, Guidance for a Technology-Inclusive, Risk-Informed, and Performance-Based Methodology to Inform the Licensing Basis and Content of Applications for Licenses, Certifications, and Approvals for Non-Light-Water Reactors (ML20091L698). NEI and the nuclear industry view the development of NEI 24-05 and NRC endorsement as important steps towards the efficient and predictable licensing of advanced reactor facilities.
