OF MARCH 6, 2024, PARTIALLY CLOSED MEETING WITH THE U.S. DEPARTMENT OF COMMERCE, NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY TO DISCUSS THE DRAFT RESPONSES TO REQUEST FOR ADDITIONAL INFORMATION REGARDING LICENSE RENEWAL APPLICATION The U.S. Nuclear Regulatory Commission (NRC) staff conducted a virtual public meeting with representatives of the U.S. Department of Commerce, National Institute of Standards and Technology (NIST) on March 6, 2024. The meeting consisted of a public session followed by a closed session for the purpose of generally discussing NISTs draft responses to the NRC staff request for additional information (RAI) dated February 9, 2024 (Agencywide Documents Access and Management System Accession No. ML23320A132) regarding NISTs license renewal application dated August 8, 2023.
I am enclosing the meeting summary for your use. The summary contains no proprietary or sensitive information and has been reviewed by both, the NRC and NIST staffs, for factual correctness.

Background
By letter dated August 8, 2023 (Agencywide Documents Access and Management System Accession No. ML23220A398), the U.S. Department of Commerce, NIST, submitted an application to the NRC for the renewal of special nuclear materials (SNM) license number SNM-362. The NRC staff conducted an acceptance review of NISTs license renewal application (LRA) and, by letter dated October 6, 2023 (ML23271A220), accepted the LRA for detailed technical review. By letter dated February 9, 2024 (ML23320A135), the NRC staff issued a request for additional information (RAI) to NIST to obtain additional information that was needed for the NRC staff to make its final regulatory findings regarding NISTs LRA. Prior to the issuance of the RAI, on January 31, 2024, the NRC staff conducted a partially closed meeting with NIST to discuss the draft RAI. The summary of that meeting can be found under ML24057A383.
The purpose of the March 6, 2024, meeting was to generally discuss NISTs draft responses to the NRC staff RAI. Below is a summary of the discussions during the meeting.
Summary of Discussions Public Session During this portion of the meeting, NIST and the NRC staff discussed the draft RAI responses on the following technical areas: radiation protection, nuclear criticality safety, fire protection,
2 material control and accounting, and radioactive waste management. During the proceedings, NIST discussed its draft responses to each one of the questions under each of the technical areas listed above.
In general, the NRC staff had no issues or requests for clarification on any of NISTs draft responses to the RAI, except for the draft response to the RAI on nuclear criticality safety. The NRC staff requested additional discussion and clarification to the proposed response, which NIST provided. Based on this discussion, the NRC staff determined that NISTs proposed response appeared to address its concerns and had no further questions. The NRC staff determined that the draft response needed no revisions and that it could be submitted as drafted.
Following the conclusion of the discussion on waste management, the public was afforded an opportunity to discuss, ask questions, or provide comments. There were no members of the public in attendance. The public portion of the meeting was adjourned at around 3:10 pm.
Closed Session The closed portion of the meeting started at 3:15 pm. NIST discussed its draft responses to the questions under the following technical areas: a) radioactive material for which a license is requested; b) physical security (fixed sites); c) transportation security; and d) emergency management. NIST representatives also discussed their revisions to the information in the license amendment request to address the NRC staff observations and editorial comments in the physical and transportation security sections of the LRA.
The NRC staff did not identify any issues with NISTs proposed responses to the RAI and determined that these adequately addressed their concerns. The NRC staff determined that the draft responses to all the non-public RAIs needed no revisions and that they could be submitted as drafted. Following the discussion of the observations and comments, the meeting was adjourned at around 4:15 PM.
