ISSUANCE OF AMENDMENT TO VALLECITOS BOILING WATER REACTOR RENEWED FACILITY LICENSE TO ADD LICENSE TERMINATION PLAN LICENSE CONDITION (EPID L-2023-LLA-0138)

Dear Phillip Ollis:

The U.S. Nuclear Regulatory Commission (NRC) is issuing the enclosed Amendment No. 22 to Facility License No. DPR-1 for the Vallecitos Boiling Water Reactor (VBWR). This amendment is in response to your application dated September 7, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23250A266), as supplemented by letters dated September 15, 2023 (ML23261A591), October 31, 2023 (ML23304A300), and March 25, 2024 (ML24085A792), GE Hitachi Nuclear Energy Americas, LLC (GEH) submitted a license amendment request (LAR) to the NRC to approve a License Termination Plan (LTP) to support termination of NRC license DPR-1.

The GEH LTP provides the details of GEHs efforts to identify and characterize the residual radioactivity associated with the VBWR reactor building. The LTP describes efforts that will provide sufficient information for the implementation of the proposed future transfer of the VBWR reactor building and residual contamination to the authority of the EVESR license, as the EVESR facility is co-located with the VBWR facility. The GEH LTP also describes how the licensee will provide financial assurance to complete decommissioning activities and to ensure that the environmental impacts of decommissioning activities are within the scope originally envisioned in documented environmental evaluations for the site.

This licensing action amends Facility License No. DPR-1 for the VBWR to reflect approval of the LTP. Specifically, the amendment adds a new License Condition 6, which incorporates the approved LTP, and establishes the criteria for determining when changes to the LTP require prior NRC approval. The amendment also renumbers the previous License Condition 6 as License Condition 7.
