APPROVAL OF THE GLOBAL LASER ENRICHMENT LLC STANDARD PRACTICE PROCEDURES PLAN AND TRANSPORTATION PLAN FOR THE NEW HEADQUARTERS BUILDING (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2023-SPR-0004 AND L-2023-SPR-0009)

Dear Pat Jenny:

The U.S. Nuclear Regulatory Commission (NRC) staff received the Global Laser Enrichment LLC (GLE) submission via letter dated August 25, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML23243A847) for approval of a new Standard Practice Procedures Plan (SPPP) and Transportation Security Plan (TSP) in support of its application for a facility clearance for the new headquarters (HQ) building. The NRC staff previously reviewed and approved GLEs SPPP on March 16, 2023 (ML23065A306) for the test loop (TL) facility located within the Global Nuclear Fuels - America controlled access area in Wilmington, NC. In parallel with this review, the NRC staff is also reviewing the Program Cyber Security Plan for incorporating the headquarters (HQ) systems into the GLE classified network.

The NRC staff conducted a review of the new SPPP and TSP and issued requests for additional information (RAI). The GLE staff provided responses to the RAIs via letters dated January 8, 2024 (ML24011A145) and submitted the final SPPP March 12, 2024 (ML24081A017). As part of the TSP review, the NRC staff conducted a site visit on October 2, 2023, as summarized in an email dated October 10, 2023 (ML23296A093, non-public). As a result of the visit, GLE submitted a revised TSP dated October 2, 2023 (ML23284A062). The NRC staff also held a number of informal technical calls to support mutual understanding of the draft RAIs and proposed responses.

The NRC staffs review and findings are documented in the non-public security evaluation reports for the SPPP and TSP found in Enclosure 1 and Enclosure 2, respectively. These include an environmental assessment of the plan updates, consistent with the requirements in Title 10 of the Code of Federal Regulations (10 CFR) Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions.

The Enclosures 1 and 2 transmitted herewith contain security related information. When separated from the enclosures, this letter and Enclosure 3 are decontrolled.

Jenny OFFICIAL USE ONLY - SECURITY-RELATED INFORMATION The SPPP and TSP for the HQ building do not fall within any of the categories of actions eligible for categorical exclusion from an environmental assessment in 10 CFR 51.22. Therefore, the NRC staff developed a simple environmental assessment resulting in a finding of no significant impact as documented in Enclosure 3. Enclosure 3 was published as a notice in the Federal Register (FR) on April 29, 2024 (89 FR 33404).

The NRC staff utilized guidance in NEI 08-11 to inform the review of the SPPP, and the staff finds that the SPPP satisfies the applicable requirements of 10 CFR Part 25, 10 CFR Part 95, and 32 CFR Part 117 and provides reasonable assurance that GLE will adequately protect classified matter and sensitive information in its possession. Therefore, the NRC staff finds that the SPPP is acceptable. The SPPP GLEP-00100-R, Revision 0 dated March 12, 2024 (ML24081A017), is approved for the GLE HQ building.

However, prior to the introduction of classified matter for storage or use at the HQ facility, the NRC staff must complete the operational readiness review of the GLE HQ facility, and GLE must receive a final inspection report from Region II.

In addition, the NRC staff determined that the TSP is consistent with NRC guidance in Regulatory Guide 7.13 and finds that the TSP meets the requirements in 10 CFR 95.39(e).

Therefore, the NRC staff finds the TSP acceptable and provides reasonable assurance that the requirements for the physical protection of classified matter during transit will be met. The TSP GLEP-00101-R, Revision 0 dated October 2, 2023 (ML23284A062) is approved for the physical protection of classified matter during transit between the TL and HQ facilities.

The NRC staff estimates that this action required approximately 200 hours0.00231 days <br />0.0556 hours <br />3.306878e-4 weeks <br />7.61e-5 months <br /> of review, which corresponds to about $60,000 ($300.00/hour). These hours were charged to the following Enterprise Project Identification Numbers (EPID) 000224/07007033/L-2023-SPR-0009, "GLE SPPP and Transportation Plan for New HQ; 000224/07007033/L-2023-SPR-0004, Global Laser Enrichment Classified Transportation Plan; and 000222/07007033/L-2021-PMP-0000, Global Laser Enrichment - Project and License Maintenance. This EPID will be closed once this review has been completed.
