APPROVAL OF GLOBAL LASER ENRICHMENT GLEP-00009-R, STANDARD PRACTICE PROCEDURES PLAN, REVISION 3 (ENTERPRISE PROJECT IDENTIFIER L-2022-LLA-0179)

Dear Pat Jenny:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed the review of GLEP-00009-R, which is Revision 3 of the Standard Practice Procedures Plan (SPPP) for the Protection of Classified Matter for Global Laser Enrichment, LLC. The revisions were submitted via letter dated November 30, 2022 (Agencywide Documents Access and Management System

[ADAMS] Accession Number ML22342A437) and updated on January 26, 2023 (ML23033A130) and February 10, 2023 (ML23053A161, non-public). The submittal requested a review for approval for several updates to the SPPP to support compliance with Title 32 of the Code of Federal Regulations (32 CFR), Part 117, National Industrial Security Program Operating Manual and several revisions to the security infrastructure. These updates represent a substantial change which require NRC approval under Title 10 of the Code of Federal Regulations (10 CFR) 95.19, Changes to security practices and procedures.

The NRC staff evaluated the changes to the SPPP (GLEP-00009-R) and determined that GLE has incorporated the requirements of 32 CFR 117 into their plan. These changes include appointing an Insider Threat Program Senior Official, committing to conducting an annual self-inspection, committing to additional role specific training, and committing to additional reporting to the NRC. The updates are implemented consistent with GLEs commitments in the compliance plan for 32 CFR 117, as previously approved via NRC letter date November 12, 2023 (ML22318A308).

Additionally, the NRC staff reviewed the changes in security infrastructure and the removal of outdated references. The NRC staff also finds that these changes are in accordance with the requirements of 10 CFR Part 95 and are therefore acceptable.

This document transmits an enclosure containing Official Use Only - Security Related Data. When separated from the enclosure, this document is decontrolled.

Jenny 2 The NRC staff finds that the revised SPPP meets the requirements in 10 CFR Part 95 and 32 CFR 117, and thereby provides reasonable assurance that GLE will continue to adequately protect classified matter in its possession. Based on the NRC staffs review documented in the enclosed security evaluation report, Revision 3 of the SPPP is approved.

This action closes Enterprise Project Identifier 000225/07007033/L-2022-LLA-0179.

In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available for public inspection in the NRC Public Document Room (PDR) or electronically from the publicly available records component of ADAMS.
