REQUEST TO REOPEN THE NUSCALE STANDARD DESIGN APPROVAL APPLICATION COMMENT PERIOD - DOCKET NO. 05200050

Dear Ms. Fields:

By email dated October 30, 2023, (available in the Nuclear Regu latory Commission (NRC)

Agencywide Documents Access and Management System (ADAMS) Acces sion No. ML23331A274), you requested that the NRC reopen the NuScale Standard Design Approval Application (SDAA) comment period and keep the comment period open until all relevant SDAA documents have been submitted to the NRC and the Advisory Committee on Reactor Safeguards completes its review of the NuScale SDAA. Yo u also requested that the NRC keep the NRC SDAA website updated, provide the application and pre-application docket numbers, provide links to the ADAMS SDAA and pre-application do ckets, post other SDAA submittals, and post meeting summaries, requests for additional information, and other significant records in the Application Review Documents for the NuScale US460 Standard Design Approval web page.

The NRC staff reviewed your request and concluded that there is no compelling reason to reopen the comment period since comments received after the com menting period will be considered, if it is practical to do so. Federal Register Notic e (FRN) 88 FR 51874 was issued on August 4, 2023, providing a Docket ID (NRC-2023-0027), location s and directions on where and how to access NuScale SDAA information (FSAR, Response to R equests for Supplemental Information, Topical reports, and docketing decision with a Doc ket No.52-050) on which comments were to be submitted by October 3, 2023 (60 days from the FRN publication date).

The FRN says, Submit comments by October 3, 2023. Comments rec eived after this date will be considered, if it is practical to do so, but the Commission is able to ensure consideration only for comments received on or before this date. In the FRN, a co ntact was provided to address questions about Docket IDs. The NRC expects a prompt request fo r help if someone had difficulties locating the SDA documents that are referenced in the FRN. The public should rely on the FRN that provided the scope of the information on which comments should be made; the FRN also provides adequate opportunit y to access the relevant d ocuments for comments.

The NRC staff periodically updates its website related to its r eview of the NuScale SDAA, https://www.nrc.gov/reactors/new-reactors/smr/licensing-activit ies/current-licensing-reviews/nuscale-us460.html. This includes the NRC SDAA Overall Review Progress dashboard. The website was last updated on August 1, 2023, and will be updated with additional information. we advise the public to rely on the NRCs publicly available AD AMS for all official information on the application Docket No. 05200050.
