Dear Mr. Tesfaye:
I recently became aware that the U.S. Nuclear Regulatory Commission (NRC) had issued a Federal Register Notice (88 Fed. Reg. 51874, August 3, 2023) for the NuScale Power, LLC, Standard design approval application; acceptance for docketing; request for comment. This Federal Register Notice was also uploaded to the Government Regulations website.
1 The August 3 Federal Register Notice (FRN) provided an opportunity for the public to comment on the NuScale Standard Design Approval Application (SDAA) from August 3 to October 3. The NRC Docket for the SDAA is 52-0050 (ADAMS Docket No.
05200050). The SDAA pre-application Docket No. is 99902078.
The NRC has webpages for the SDAA to provide information to the public regarding the 2
SDAA and the NRC review of the Application. However, I find no information on these

Federal Register Notice: Receipt and Availability of NuScale Standard Design Approval Application, dated March 17, 2023, but it does not include the August 3 FRN. Nor do I find any information regarding the NRC Docket Number for the SDAA or a link to the SDAA documents on ADAMS on the information webpages for the SDAA.
The NRC Dashboard provides a list of several High Impact Technical Issues (HITIs) related to the SDAA and Requests for Additional Information (RAIs) that NuScale will be responding to. Although the website states, As the review progresses, the dashboard will be updated to reflect new information, it is unclear how often it is updated. The information at the bottom of the page states, Page Last Reviewed/Updated Sunday, January 1, 2023, which was 10 months ago.
In sum, 1) the NRC did not provide any information regarding the opportunity for public comment on the NuScale Current Licensing Reviews of New Reactors webpage for the NuScale US460 Standard Design Approval Application Review; 2) there are still important SDAA documents and information recently submitted and yet to be submitted to the NRC, for example, the September 29, 2023, Audit Status contains a list of 200 information items to be submitted to the NRC staff; and 3) is a need for informed public comment.
Given the facts above, I request that the NRC reopen the NuScale Standard Design Approval Application comment period and keep the comment period open until all relevant SDAA documents have been submitted to the NRC and the Advisory Council on Rectory Safety (ACRS) completes its review of the NuScale SDAA.
I also request that the NRC keep the NRC SDAA website updated, provide the application and pre-application docket numbers, provide links to the ADAMS SDAA and pre-application dockets, post other SDAA submittals, and post meeting summaries, requests for additional information, and other significant records in the Application Review Documents for the NuScale US460 Standard Design Approval webpage.
