Dear Ross Monaghan:

The U.S. Nuclear Regulatory Commission (NRC) staff has received your submittal dated September 28, 2023 (Agencywide Documents Access and Management System [ADAMS]

Number ML23284A126), requesting NRC to complete its annual review of MITs use of the self-guarantee financial test to demonstrate financial assurance, as specified in 10 CFR Part 70 and 10 CFR Part 72, as ongoing compliance with MITs Self-Guarantee Agreement for the Part 70 special nuclear materials (SNM) license, SNM-0986.

We have completed our acceptance review of your submittal and have identified no administrative omissions or deficiencies that would prevent us from proceeding with a detailed review. Your submittal has been assigned Cost Activity Code/Enterprise Project Identification Number L-2023-DFB-0070. Please reference this number and Docket Number 07000938 in any future correspondence associated with this request.

Please note that the NRC staffs technical review of your submittal may identify issues that could require that you provide additional information. Based on our preliminary evaluation and projection of current review schedules, we anticipate completing our formal review by January 2024. This schedule includes the issuance, if needed, of a request for additional information (RAI) by the end of December 2023 and receiving your response to the RAI 20 days after its issuance. Please note that these dates could change depending on the findings of our technical review, urgent assignments, or other factors, such as whether your responses to the RAI are or not adequate. Within 30 days after completion of the NRC staff review of your application/submittal, a notice will be published in the Federal Register to inform the NRC staffs decision regarding your submittal. The NRC staff recognizes that as a nonprofit university, MIT is exempted from licensing fees associated with this action. We will promptly communicate significant schedule and/or cost changes, if any.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS. The ADAMS database is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

If you have any questions regarding this communication, please contact me at 301-415-2328, or via e-mail to Jennifer.Tobin@nrc.gov.
