UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 Glen Shor, Executive Vice President and Treasurer Massachusetts Institute of Technology 77 Massachusetts Avenue Building 4-204 Cambridge, MA 02139-4307

SUBJECT:

ANNUAL SELF-GUARANTEE, SPECIAL NUCLEAR MATERIALS LICENSE SPECIAL NUCLEAR MATERIALS LICENSE-986 (ENTERPRISE PROJECT IDENTIFICATION CODE: L-2023-DFB-0070)

Dear Glen Shor,

By letter dated September 28, 2023 (Agencywide Documents Access and Management System

[ADAMS] Number ML23072A402), the Massachusetts Institute of Technology, in Cambridge, Massachusetts, submitted to the U.S. Nuclear Regulatory Commission (NRC) a document with a certified amount of financial assurance and associated annual self-guarantee test for Special Nuclear Materials License (SNM)-986. The Financial Assessment Branch of the Division of Rulemaking, Environmental, and Financial Support in the Office of Nuclear Material Safety and Safeguards conducted the technical review of the adequacy of the submittal for SNM-986.

The NRC staff concludes that the self-guarantee meets or exceeds the financial test criteria for a non-profit university that issues bonds, is acceptable for providing decommissioning funding assurance, and complies with Title 10 of the Code of Federal Regulations (10 CFR) Paragraphs 70.25(f)(2) and 50.75(e)(1)(iii)(C), appendix E to 10 CFR Part 30, and is consistent with NUREG-1757, Volume 3, Rev. 1. A safety evaluation report for the analysis of the materials license is enclosed.

As a reminder, the self-guarantee must be submitted within 90 days of the close of the fiscal year. The requirements are established by the Final Decommissioning Planning Rule and the guidance provided in NUREG-1757, Volume 3, Rev. 1.

In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS. The ADAMS database is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html. The PDR is open by appointment. To make an appointment to visit the PDR, please send an email to PDR.Resource@nrc.gov or call 1-800-397-4209 or 301-415-4737, between 8 a.m. and 4 p.m. eastern time (ET), Monday through Friday, except Federal holidays.
