SUMMARY
OF AUGUST 15, 2023, FUEL CYCLE CONSTRUCTION OVERSIGHT WORKSHOP PUBLIC MEETING The staff of the U.S. Nuclear Regulatory Commission (NRC) conducted a hybrid meeting (in-person and virtual via Microsoft Teams) with representatives of the Nuclear Energy Institute (NEI), licensees in the fuel facility industry, applicants for licenses under 10 CFR Part 70, and members of the public on August 15, 2023. The purpose of the meeting was to discuss proposed updates to the construction inspection program for fuel cycle facilities. Topics discussed include lessons-learned from other nuclear construction projects, proposed characterization of potential findings, and conduct of readiness-reviews prior to the authorization to possess special nuclear material. The workshop included presentations on inspection sample selection using a risk-ranking methodology, applicability of management measures during pre-construction, construction, and pre-operations phases, and risks of construction prior to the issuance of a license.

Meeting Summary:
The meeting began with the NRC providing an overview of the meetings purpose and logistics.
Opening remarks were made by Laura Dudes, Regional Administrator - Region II, and Anthony Masters, Director - Division of Fuel Facility Inspection.
After opening remarks, the NRC staff provided a series of morning presentations followed by question and answer (Q&A) sessions. Morning presentations covered proposed updates to Inspection Manual Chapter (IMC) 2694 and its associated inspection procedures (IPs); lessons learned from previous nuclear construction projects; at-risk construction; and the characterization of inspection findings, annual assessments, and readiness reviews. A series of afternoon presentations were given that covered a risk-informed inspection sample tool for Items Relied Upon for Safety (IROFS) during construction and readiness reviews, and a presentation describing expectations for management measures inspections during pre-construction, construction, and pre-operations phases of a fuel facility construction project. The afternoon session concluded with an open forum Q&A session. The afternoon session presentations were chaired by Anthony Masters, Director for the Division of Fuel Facility Inspection, Region II.
The meeting was closed by Carrie Safford, Deputy Director for the Division of Fuel Management, in the Office of Nuclear Material Safety and Safeguards.
Action Items:
Stemming from this meeting, the NRC has committed to ongoing discussions related to fuel facility construction inspection program development via additional public meetings - and during the next public Fuel Facilities Stakeholder Meeting that is tentatively scheduled for November 8, 2023. Based on discussions held during the public meeting, the NRC has broadly captured the following action items that will be addressed in subsequent meetings:
The NRC will clarify the applicability of the Construction Inspection Program (IMC 2694) for existing licensees undergoing construction.
The NRC will provide resource estimate(s) for licensee/applicant budgeting purposes for construction oversight.
The NRC will engage in public meetings to work through examples, questions, and inspection scenarios with licensees, applicants, and the public.
The NRC will clarify the scope of inspections for licensee/applicant structures that are not designated as IROFS.
The NRC will engage in further discussion on procurement inspection, QC inspection, and acceptance criteria for commercial items used in IROFS.
