20-1225, 21-1104, 21-1147 CERTIFICATE AS TO PARTIES, RULINGS, AND RELATED CASES Pursuant to D.C. Circuit Rules 27(a)(4) and 28(a)(1)(A), undersigned counsel for Petitioners Fasken Land and Minerals, Ltd. and Permian Basin Land and Royalty Owners certify as follows:
- 1. Parties, Intervenors, and Amici Curiae Petitioners are Fasken Land and Minerals, Ltd. and Permian Basin Land and Royalty Owners. Respondents are the United States Nuclear Regulatory Commission (NRC or Commission) and the United States of America.
Currently, Intervenor is Holtec International.
- 2. Rulings Under Review Petitioners seek review of NRC Memorandum and Order CLI-20-04, issued on April 23, 2020 (CLI-20-04); and NRC Memorandum and Order CLI-21-07, issued on April 28, 2021 (CLI-21-07). All respective orders were issued in a USCA Case #20-1187 Document #2008031 Filed: 07/14/2023 Page 1 of 2
2 license proceeding before the Commission captioned In the Matter of Holtec International (HI-STORE Consolidated Interim Storage Facility for Interim Storage of Spent Nuclear Fuel), NRC Docket No. 72-1051. The Commissions orders, CLI-20-04 and CLI-21-07, rely on findings and conclusions issued by the Atomic Safety and Licensing Board, namely Memorandum and Order LBP-19-4, issued on May 7, 2019, and Memorandum and Order LBP-20-06, issued on June 18, 2020.
- 3. Related Cases Petitioners case is related to Case Nos. 20-1225, 21-1104 and 21-1147 filed in the United States Court of Appeals for District of Columbia Circuit.
