LIMERICK GENERATING STAT ION, UNIT 1 - CORRECTION TO THE RENEWED FACILITY OPERATING LICENSE PAGES IN AMENDMENT NOS. 255, 256, 257, 258, 259, AND 260 (EPID L-2019-PMP-0058)

Dear Mr. Rhoades:

The U.S. Nuclear Regulatory Commission (NRC) staff has identified typographical errors in Renewed Facility Operating License (RFOL) No. NPF-39 (RFOL NPF-39) for Limerick Generating Station (Limerick), Unit 1. The NRC staff is issuing this letter to correct the errors per the guidance in the NRC memorandum dated January 16, 1997 (Agencywide Documents Access and Management System Accession (ADAMS) No. ML103260096), which is derived from the Staff Requirements Memorandum (SRM, ML003754054) for SECY-96-238 (ML20134M324, non-public).

By letter dated February 1, 2022 (ML22021B659), the NRC staff issued Amendment No. 255 to RFOL NPF-39 for Limerick, Unit 1 in response to the license transfer application (ML21057A273), as supplemented (ML21084A165), from Exelon Generation Company, LLC (Exelon). The NRC staffs safety evaluation (ML21277A248) related to the license transfer application was provided with the corresponding order (ML21277A192).

of the licensees supplement (ML21084A165) shows the licensees requested changes to pages 1, 2, 3, and 4 (among other pages) of RFOL NPF-39. The licensee did not request paragraph 1.G of RFOL NPF-39 to be shifted to the next page, nor did the licensee request the shifting of text on subsequent pages that would result from paragraph 1.G being moved to the next page. However, as shown in Enclosure 1 (ML22021B660) to the letter dated February 1, 2022 (ML22021B659), the NRC issued Amendment No. 255 that shifted paragraph 1.G from page 1 to page 2, which caused the shifting of text on pages 2, 3, and 4 that the licensee did not request. For example, the text for paragraph 2.C(2), Technical Specifications, of RFOL NPF-39 shifted from page 3 to page 4.

The shifting of text on pages 1, 2, 3, and 4 in RFOL NPF-39 resulted in typographical errors, inadvertent omissions of license condition langu age, and inconsistencies in later amendments:

Amendment No. 256 (ML22003A186) issued on February 17, 2022, placed paragraph 2.C(2) of RFOL NPF-39 on page 3 and reflected the version of page 3 prior to the license transfer amendment.

Amendment No. 257 (ML22090A086) issued on April 29, 2022, placed paragraph 2.C(2) of RFOL NPF-39 on page 4.

Amendment No. 258 (ML22272A037) issued on January 3, 2023, placed paragraph 2.C(2) of RFOL NPF-39 on page 3 and reflected the version of page 3 prior to the license transfer amendment.

Amendment No. 259 (ML23005A008) issued on February 23, 2023, placed paragraph 2.C(2) of RFOL NPF-39 on page 4.

Amendment No. 260 (ML22348A176) issued on March 7, 2023, placed paragraph 2.C(2) of RFOL NPF-39 on page 4 but made an erroneous change to page 3 that reflected the version of page 3 prior to the license transfer amendment.

(The typographical errors did not affect Amendment No. 261 (ML23090A163) issued on May 17, 2023.)

To correct these errors, the NRC staff is re-issuing RFOL NPF-39 pages 1, 2, 3, and 4 to (1) reflect the format and page location of the license conditions that the licensee requested in its license transfer application, and (2) refl ect the latest applicable amendment (Amendment No. 260) in paragraph 2.C(2), which will appear on page 3. The NRC staff determined that these editorial corrections to the RFOL NPF-39 pages do not change any of the NRC staffs conclusions in its safety evaluations regarding the acceptability of the changes approved in Amendment Nos. 255 through 260 (the safety evaluations did not address the page locations of the applicable license conditions), nor do the corrections affect the applicable no significant hazards considerations published in the Federal Register on December 1, 2020 (85 FR 77274),

November 30, 2021 (86 FR 67988), February 22, 2022 (87 FR 9647), and June 14, 2022 (87 FR 36007 and 87 FR 36003).

Accordingly, the enclosure to this letter has a copy of the revised and corrected RFOL NPF-39 pages 1, 2, 3, and 4.

RENEWED FACILITY OPERATING LICENSE

Renewed License No. NPF-39

1. The Nuclear Regulatory Commission (the Commission or the NRC) has found that:

A. The application for renewed license filed by Exelon Generation Company, LLC*

complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions regulations set forth in 10 CFR Chapter I, and all required notifications to other agencies or bodies have been duly made;

B. Construction of the Limerick Generating Station, Unit 1 (the facility) has been substantially completed in conformity with Construction Permit No. CPPR-106 and the application, as amended, the provisions of the Act and the regulations of the Commission;

C. The facility will operate in conformity with the application, as amended, the provisions of the Act, and the regulations of the Commission (except as exempted from compliance in Section 2.D. below);

D. There is reasonable assurance: (i) that the activities authorized by this renewed operating license can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations set forth in 10 CFR Chapter I (except as exempted from compliance in Section 2.D. below);

E. Constellation Energy Generation, LLC (the licensee) is technically qualified to engage in the activities authorized by this renewed license in accordance with the Commissions regulations set forth in 10 CFR Chapter I;

F. The licensee has satisfied the applicable provisions of 10 CFR Part 140, Financial Protection Requirements and Indemnity Agreements, of the Commissions regulations;

G. The issuance of this renewed license will not be inimical to the common defense and security or the health and safety of the public;

  • The Commission approved a transaction on November 16, 2021, that resulted in Exelon Generation Company, LLC being renamed Constell ation Energy Generation, LLC.

H. After weighing the environmental, economic, technical, and other benefits of the facility against environmental and other costs and considering available alternatives, the issuance of this Renewed Facility Operating License No. NPF-39, subject to the conditions for protection of the environment set forth in the Environmental Protection Plan attached as Appendix B, is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied; and

I. The receipt, possession, and use of source, byproduct and special nuclear material as authorized by this renewed license will be in accordance with the Commissions regulations in 10 CFR Parts 30, 40 and 70.

J. Actions have been identified and have been or will be taken with respect to (1) managing the effects of aging during the period of extended operation on the functionality of structures and components that have been identified to require review under 10 CFR 54.21(a)(1), and (2) time-limited aging analyses that have been identified to require review under 10 CFR 54.21(c),

such that there is reasonable assurance that the activities authorized by the renewed operating license will continue to be conducted in accordance with the current licensing basis, as defined in 10 CFR 54.3, for the facility, and that any changes made to the facilitys current licensing basis in order to comply with 10 CFR 54.29(a) are in accordance with the Act and the Commissions regulations.

2. Based on the foregoing findings, the Partial Initial Decisions issued by the Atomic Safety and Licensing Board dated March 8, 1983, August 29, 1984, May 2, 1985 and July 22, 1985, and the Decision of the Appeal Board dated September 26, 1984, regarding this facility, and approval by the Nuclear Regulatory Commission in its Memorandum and Order dated August 8, 1985, the license for Fuel Loading and Low Power Testing, License No. NPF-27, issued on October 26, 1984, is superseded by Renewed Facility Operating License NPF-39 hereby issued to Constellation Energy Generation, LLC (the l i c e n s e e ), t o read as follows:

A. This renewed license applies to the Limerick Generating Station, Unit 1, a boiling water nuclear reactor and associated equipment, owned by Constellation Energy Generation, LLC. The facility is located on the licensees site in Montgomery and Chester Counties, Pennsylvania on the banks of the Schuylkill River approximately 1.7 miles southeast of the city limits of Pottstown, Pennsylvania and 21 miles northwest of the city limits of Philadelphia, Pennsylvania, and is described in the licensees Final Safety Analysis Report, as supplemented and amended, and in the licensees Environment al Report-Operating License Stage, as supplemented and amended.

B. Subject to the conditions and requirements incorporated herein, the Commission hereby licenses Constellation Energy Generation, LLC:

(1) Pursuant to Section 103 of the Act and 10 CFR Part 50, to possess, use, and operate the facility at the designated location in Montgomery and Chester Counties, Pennsylvania, in accordance with the procedures and limitations set forth in this renewed license;

(2) Pursuant to the Act and 10 CFR Part 70, to receive, possess and to use at any time special nuclear material as reactor fuel, in accordance with the limitations for storage and amounts required for reactor operation, as described in the Final Safety Analysis Report, as supplemented and amended;

(3) Pursuant to the Act and 10 CFR Parts 30, 40 and 70, to receive, possess and use at any time any byproduct, source and special nuclear material as sealed neutron sources for reactor startup, sealed sources for reactor instrumentation and radiation monitoring equipment calibration, and as fission detectors in amounts as required;

(4) Pursuant to the Act and 10 CFR Parts 30, 40, 70, to receive, possess, and use in amounts as required any byproduct, source or special nuclear material without restriction to chemical or physical form, for sample analysis or instrument calibration or associated with radioactive apparatus or components; and

(5) Pursuant to the Act and 10 CFR Parts 30, 40 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of the facility, and to receive and possess, but not separate, such source, byproduct, and special nuclear materials as contained in the fuel assemblies and fuel channels from the Shoreham Nuclear Power Station.

C. This renewed license shall be deemed to contain and is subject to the conditions specified in the Commissions regulations set forth in 10 CFR Chapter I (except as exempted from compliance in Section 2.D. below) and is subject to all applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below:

(1) Maximum Power Level

Constellation Energy Generation, LLC is authorized to operate the facility at reactor core power levels not in excess of 3515 megawatts thermal (100% rated power) in accordance with the conditions specified herein and in Attachment 1 to this license. The items identified in Attachment 1 to this renewed license shall be completed as specified. Attachment 1 is hereby incorporated into this renewed license.

(2) Technical Specifications

The Technical Specifications contained in Appendix A and the Environmental Protection Plan contained in Appendix B, as revised through Amendment No. 260, are hereby incorporated into this renewed license. Constellation Energy Generation, LLC shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

(3) Fire Protection (Section 9.5, SSER-2, -4)

Constellation Energy Generation, LLC shall implement and maintain in effect all provisions of the approved Fire Protection Program as described in the Updated Final Safety Analysis Report for the facility, and as approved in the NRC Safety Evaluation Report dated August 1983 through Supplement 9, dated August 1989, and Safety Evaluation dated November 20, 1995, subject to the following provision:

The licensee may make changes to the approved fire protection program without prior approval of the Commission only if those changes would not adversely affect the ability to achieve and maintain safe shutdown in the event of a fire.

The Information contained on FOL pages 5 and 6 was intentionally omitted.

The parenthetical notation following the title of many license conditions denotes the section of the Safety Evaluation Report and/or its supplemen ts wherein the license condition is discussed.
