Dear Mr. Rhoades:

The U.S. Nuclear Regulatory Commission (NRC or the Commission) has issued the enclosed Amendment Nos. 261 and 223 to Renewed Facility Operating License Nos. NPF-39 and NPF-85 for the Limerick Generating Station, Units 1 and 2 (Limerick), respectively, in response to Exelon Generation Company, LLCs (the licensees) application dated March 11, 2021, as supplemented by letters dated May 5, 2021, December 15, 2021, February 14, 2022, and June 30, 2022. On February 1, 2022, Exelon Generation Company, LLC was renamed Constellation Energy Generation, LLC.

On July 31, 2018, the NRC issued Amendment Nos. 230 and 193 to Renewed Facility Operating License Nos. NPF-39 and NPF-85, respectively, which added a new license condition in Appendix C of the operating licenses that allowed the licensee to implement Title 10 of the Code of Federal Regulations (10 CFR), Section 50.69, Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors. Amendment Nos. 261 and 223 to Renewed Facility Operating License Nos. NPF-39 and NPF-85 revise this license condition in each license to allow the use of an alternative seismic approach to categorizing structures, systems, and components in the licensees application of 10 CFR 50.69. The NRC staffs safety evaluation for these amendments is in Enclosure 3 to this letter.

The licensee also requested approval of proposed alternative defense-in-depth and pressure boundary processes for categorizing structures, systems, and components in the licensees application of 10 CFR 50.69. By telephone conference dated December 15, 2022, the NRC staff informed your staff of its plans for the approval of the proposed alternative seismic approach and denial of the proposed alternative defense-in-depth and pressure boundary processes and offered your staff the opportunity for a public meeting to discuss the proposed partial denial of the license amendment request (LAR), prior to the NRC staffs issuance of the partial denial of

the LAR. Your staff requested to have the public meeting, and the NRC staff held the public meeting with your staff on February 23, 2023.

Based upon its review, the NRC staff has concluded that it cannot approve these two proposed processes. Therefore, the LAR is approved in part and denied in part. Accordingly, the NRC staffs notice of denial of the portion of the LAR that has been denied will be published in the Federal Register notice. The basis for this finding is documented in the safety evaluation in to this letter, which explains the nature of any deficiencies and the reason for the denial. Under Title 10 of the Code of Federal Regulations (10 CFR) 2.103(b)(2), within 20 days from the date of the notice of denial, which will be published in the Federal Register, you may demand an adjudicatory hearing with respect to this denial. Under 10 CFR 2.307(a), you may request an extension of this time limit if you can show good cause. Enclosure 5 to this letter has additional instructions for demanding an adjudicatory hearing with respect to this denial.

The NRC staff has included a copy of the notice of issuance of the amendments and of the partial denial of the amendment request in Enclosure 5 to this letter and will forward it to the Office of the Federal Register for publication.

The U.S. Nuclear Regulatory Commission (the Commission) has found that:

The application for amendment by Exelon Generation Company, LLC,1 dated March 11, 2021, as supplemented by letters dated May 5, 2021, December 15, 2021, February 14, 2022, and June 30, 2022, complies, to the extent discussed in the NRC staffs safety evaluation dated May 17, 2023, with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions rules and regulations set forth in 10 CFR Chapter I; B.

The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C.

There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations; D.

The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E.

The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.
