By letter dated November 30, 2022 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML22340A461), American Centrifuge Operating (ACO), a wholly owned subsidiary of Centrus Energy Corp. (Centrus), requested that the U.S. Nuclear Regulatory Commission (NRC) modify its Materials License SNM-2011 for the American Centrifuge Plant (ACP) in Piketon, Ohio. The ACP license was issued in 2007 under Title 10 of the Code of Federal Regulations (10 CFR), parts 30, 40 and 70 for a period of 30 years (ML070400284; non-public). The licensees letter requested an extension of the NRCs authorization for the High Assay Low-Enriched Uranium (HALEU) program from November 30, 2022 (ML22208A057) through December 31, 2024, or until production of the licensed amount of HALEU is reached, whichever comes first. The NRC had previously extended its authorization under ACPs Materials License SNM-2011 for ACOs HALEU program from May 31, 2022, to November 30, 2022 (ML22208A057). As part of its request, ACO proposed to extend the expiration date in License Condition 15 to December 31, 2024. As part of the amendment request, the licensee also proposed a new License Condition (LC) for the ACP license SNM-2011 to limit the amount of special nuclear material (SNM) possessed at the ACP to below the Category II quantity thresholds until the installation of a storage system for Category II SNM is completed.

Enclosures 1 and 3 transmitted herewith contain sensitive non-public information.

The details associated with the review are documented in the enclosed non-public safety evaluation report (SER). Also enclosed is a redacted public version of the SER. As part of this licensing action, License Condition (LC) 10.e has been modified to incorporate, in the enclosed license, the application submitted on November 30, 2022 (ML22340A461). In addition, LC 15 has been modified to address the expiration date changes related to ACOs HALEU contract with the Department of Energy. In addition, a new LC 29 has been added to limit the amount of SNM possessed at the ACP to below the Category II quantity thresholds until the installation of a storage system for Category II SNM is completed.

In accordance with 10 CFR Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and Enclosure 3 will be available electronically for public inspection in the NRC Public Document Room (PDR), or from the Publicly Available Records component of the NRCs ADAMS.
