ORDER (Denying in Part and Granting in Part Applicants Renewed Motion to Strike)

Before the Board is Applicants Renewed Motion to Strike Portions of the Michigan Attorney Generals Written Responses and Rebuttal Testimony of Nicholas J. Capik. 1 For the reasons stated on the record at the hearing held February 8-9, 2023, the Renewed Motion is DENIED IN PART and GRANTED IN PART.

First, Applicants request that the Board strike portions of the Michigan Attorney Generals responses and supporting testimony relating to comparisons between the Palisades estimate, on 1 Applicants Motion to Strike Portions of the Michigan Attorney Generals Written Responses and Rebuttal Testimony of Nicholas J. Capik (Jan. 3, 2023). The undersigned initially denied Applicants motion at the beginning of the hearing held February 8-9, 2023.

However, the undersigned gave Applicants leave to renew their motion at the close of the hearing. Applicants orally renewed their motion on the record at the close of the hearing on February 9, 2023.

Second, Applicants request that the Board strike portions of the Michigan Attorney Generals responses and supporting testimony relating to the 2030 start date for DOE pickup of spent nuclear fuel. The Renewed Motion is GRANTED as to this category of testimony and responses, and the following portions are hereby stricken:

  • Exhibit MICH019, Rebuttal Testimony of Nicholas Capik (Dec. 16, 2022): Page 9, lines 10-15 (including footnotes); and
  • Michigan Attorney Generals Written Responses and Rebuttal Testimony With Supporting Affidavit (Dec. 16, 2022): Page 9, indented paragraph a. in its entirety; page 10, indented paragraph b. in its entirety; and page 10, paragraph e., second sentence.
