ORDER (Denying Request for Extension of Time)
On January 16, 2008, the Commission published two Notices in the Federal Register inviting members of the public to file petitions to intervene and requests for hearing within 20 days regarding a proposed Entergy corporate restructuring and indirect license transfer insofar as they related to Entergys Big Rock Point and Palisades facilities. 73 Fed. Reg. 2948, 2956.
The Notices explained that interested petitioners should file electronically with the Commissions Office of the Secretary (SECY); it also provided contact information for petitioners needing assistance with electronic filing. The 20-day filing period expired February 5, 2008.
In response, at 11:45 p.m. on February 5th, Michael J. Keagan and others sent a short e-mail - not to SECY but instead to Douglas Pickett, the Commissions Project Manager for the proposed Entergy corporate restructuring and indirect license transfer. Signing the e-mail [o]n behalf of Don't Waste Michigan and many others, Mr. Keagan et al. requested a 45-day extension of time for Dont Waste Michigan to file a request for hearing. The entirety of the signatories justification reads as follows:
there is potential that safety concerns regarding these nuclear facilities could be potentially compromised by the pursuit of profit over safety. Twenty days is not enough to review the documents related to this transferral appropriately.
On February 6, 2008, Mr. Pickett forwarded the e-mail to the Office of the Secretary.
2 The extension request is denied. The submitters provided only the most general justification - and no reason related to this proceeding in particular -- as to why they needed 45 days in addition to the regulatorily prescribed 20 days to file a request for hearing. Two labor union locals filed their petitions to intervene and requests for hearing within the prescribed 20-day period.
In addition, the submitters did not comply with several of the Commissions procedural rules described in both Federal Register Notices: they did not submit their request to SECY and did not follow the E-Filing rule (72 Fed. Reg. 49,139 (Aug. 28, 2007)). Moreover, they did not consult with the license transfer applicants or append to their extension request the requisite certification pursuant to 10 C.F.R. § 2.323(b).
