An incident report released by the FAA provides the following details: "PRELIM INFO FROM FAA OPS: WILKES-BARRE, PA/UAS SIGHTING/0100E/WILKESBARRE ATCT REPORT UAS IN THE BERWICK POWER PLANT PROTECTED AIRSPACE 25 SW AVP. POWER PLANT SECURITY PERSONNEL REPORTED THE UAS APPEARED TO BE MILITARY IN SIZE AND TYPE. FBI NOTIFICATION NUMBER NOT PROVIDED."

APP1- Schwartz, - Appealing the partial denial of information 12/01/2022 2023- Greg in FOIA-2023-000022. I have received 000001 NRC OIG's response to my FOIA request. While largely informative, the 17-page document omits the names of NRC personnel making key decisions regarding NRC oversight of regulatory matters at the Diablo Canyon nuclear plant. This information was withheld under Exemption 7 c, with the claim that "Disclosure could reasonably be expected to constitute an unwarranted invasion of personal privacy." I wish to appeal this exemption due to the fact that these are matters of public interest, and the public very much has a right to know who was making the assumptions and presumptions behind these decisions. I would argue that the public's right to know who these decision makers are outweighs their right to personal privacy, since they are or were public government employees making decisions that could potentially affect the entire region and state.

Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending December 2, 2022 NRC Issues Order to SHINE Medical Isotope Production Facility On November 30, 2022, the U.S. Nuclear Regulatory Commission (NRC) staff issued an order amending the construction permit for the SHINE Medical Isotope Production Facility (SHINE facility) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22292A319). On April 1, 2022, SHINE Medical Technologies, LLC (SHINE) requested to amend Construction Permit No. CPMIF-001 to extend the latest date for construction completion of the SHINE facility from December 31, 2022, to December 31, 2025, and to administratively change the name of the construction permit holder from SHINE Medical Technologies, LLC to SHINE Technologies, LLC (ML22091A093). This amendment process is consistent with that used to extend the latest completion date for construction to construction permits for power reactors. Additionally, NRC staff are on track to issue the safety evaluation report for SHINEs operating license application by December 31, 2022.

NRC Hosts Meeting to Discuss Seismic Hazard Updates for Nuclear Power Plants On November 29, 2022, the NRC hosted a hybrid public meeting with members of the Nuclear Energy Institute (NEI) and the Electric Power Research Institute to discuss seismic hazard updates for nuclear power plants using the process for the ongoing assessment of natural hazards information (POANHI) (ML22319A028). The NRC staff are assessing new ground motion models and updated site response information to determine impacts to our understanding of seismic hazard at US nuclear power plants. Approximately 85 attendees participated in-person or via Teams including observers from Ontario Power Generation and the Spanish regulatory authority. Presentations were provided by the NRC and by NEI. Questions and comments focused on the POANHI screening process, the schedule for completing the initial seismic hazard assessments, and documentation of the assessments.

Constellation Energy Generation, LLC Submits Response for Digital Instrumentation and Controls License Amendment Request On November 29, 2022, Constellation Energy Generation, LLC (Constellation) submitted its response (ML22333A817) to the NRCs opportunity to supplement letter (ML22320A113) for the Limerick digital instrumentation and controls (I&C) license amendment request. The NRC staff is currently conducting an acceptance review of the Limerick digital I&C license amendment request (ML22269A569), which was submitted by Constellation on September 26, 2022. Using the additional information provided by Constellation, the NRC staff will complete the acceptance review of the amendment request by December 9, 2022.

Items of Interest Week Ending December 2, 2022 Fitness for Duty Drug Testing Requirements: Final Rule and Guidance; Issuance; 10 CFR Part 26 (RIN 3150-AI67; NRC-2009-0225)

On November 22, 2022, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 71422) amending its regulations regarding fitness for duty (FFD) programs for certain NRC licensees and other entities to align the NRCs drug testing requirements more closely with the updates made to the U.S. Department of Health and Human Services Mandatory Guidelines for Federal Workplace Drug Testing Programs in 2008 and as revised in 2017. This final rule also incorporates lessons learned from implementing the NRCs current FFD regulations. These changes enhance the ability of NRC licensees and other entities to identify individuals using illegal drugs, misusing legal drugs, or attempting to subvert the drug testing process. This final rule provides additional protections to individuals subject to drug testing and improves the clarity, organization, and flexibility of the NRCs FFD regulations. The NRC also is issuing final implementation guidance for this final rule. This final rule is effective December 22, 2022. Compliance with this final rule is required by November 22, 2023.

Licensing Safety Analysis for Loss-of-Coolant Accidents: Petition for Rulemaking; Notice of Docketing and Request for Comment; 10 CFR Part 50 [NRC-2022-0178]

On November 23, 2022, the NRC published a notice in the Federal Register (87 FR 67571) announcing that it will consider in its rulemaking process the issue raised in a petition for rulemaking (PRM), PRM-50-124, submitted by Ralph O. Meyer dated August 1, 2022. The petitioner requested that the NRC revise its regulations regarding the licensing safety analysis for loss-of-coolant accidents. The NRC is examining the issues raised in PRM-50-124 to determine whether they should be considered in rulemaking. Comments are requested by February 6, 2023.

NRC Completed Acceptance Review of Disa Technologies, Inc. License Application On November 29, the NRC staff informed Disa Technologies, Inc. that it had completed its regulatory and acceptance review of Disas license application for the use of high-pressure slurry ablation technology. The staff communicated its decision via letter (ML22318A006) and a phone call to the applicant explaining that the application was not accepted for review as it did not address the Title 10 of the Code of Federal Regulations Part 40 Appendix A criteria.

Specifically, the technology should be licensed under the uranium milling regulatory framework instead of the source material regulatory framework.

NRC Virtual Public Meeting on Emergency Preparedness and Security Requirements for Nuclear Power Reactor Facilities Undergoing Decommissioning On November 30, NRC staff held a virtual public meeting to provide information related to emergency preparedness (EP) and security requirements for nuclear power reactor facilities undergoing decommissioning. A presentation was given by NRC staff from the NMSS and NSIR on Emergency Preparedness and Security for Decommissioning reactors, followed by a question-and-answer session (ML22329A077). Approximately 100 participants were in the meeting, including NRC staff, state staff, congressional staff, and members of the public. Staff received questions from the public on the topics of pipeline ruptures at Indian Point, coordination with counties regarding EP, spent fuel pool risks, frequency of decommissioning inspections, and examples of security and EP findings. This meeting was recorded and will be placed on the agencys YouTube channel to support future discussions regarding these topics.
