The changes request herein include those provisions necessary for general licensees to addresses NRCs Enforcement Guidance Memo (EGM)22-001 issued on April 15, 2022. Reference 7 requested the changes being proposed to the Technical Specifications (TS) in Amendment 12 be included in Amendments 0 thru 9 via the issuance of a Certificate of Compliance (CoC) revision. Additionally, due to the timing of this request and the approval of Amendment 10 to the MAGNASTOR Cask System (effective date January 18th, 2023), NAC is requesting a revision to Amendment 10.

These administrative controls were added to FSAR Chapter 9, which include actions that may be used prior to and during operations conducted outside. This will place important to safety structures, systems, and components in an analyzed condition should there be a severe weather hazard (e.g., weather advisory, warning, or watch) predicted or issued for the area. The changes to Chapter 9 are common to both the Proprietary and Non-Proprietary versions of the FSAR. In an effort to avoid a 10 CFR Part 72 backfit review, NAC is providing via Enclosure 1, herein, formal letters from all our current MAGNASTOR users which documents their intent to adopt the revised CoCs after they become effective in 10 CFR Part

72. The letters cover the following ISFSIs: Palo Verde, Duke-McGuire, Duke-Catawba, Kewaunee, TMI-1, and Zion.

Consistent with NAC administrative practice, this proposed FSAR revision is numbered to uniquely identify the applicable changed pages. Revision bars mark the FSAR text changes on the Revision 22E pages (Enclosure 2). The included List of Effective Pages (Enclosure 2) identifies the revision level of all pages in the Reference 2 FSAR with Revision 22E incorporated. Enclosure 1 contains the List of FSAR Changes. In order to better facilitate the review process, NAC is providing the Revision 22E changed page with appropriate backing pages. In accordance with NACs administrative practices, upon final acceptance of this application, the changed pages will be reformatted and incorporated into the next revision of the MAGNASTOR FSAR.

The NRC has issued the referenced EGM regarding tornado hazards protection compliance at Independent Spent Fuel Storage Installations (ISFSI). Additionally, NEI has issued recommended actions to be taken in response to the EGM.

This letter is to document the Palo Verde Generating Station (PVGS) request to NAC International (certificate holder for the UMS and MAGNASTOR systems used at PVGS) to submit a CoC amendment request, and adopt the amendment, if approved by the NRC to allow PVGS to utilize administrative controls to mitigate tornado hazards during periods of ISFSI handling operations.

Dear Mr. Fowler,

On April 15, 2022, NRC Issued EGM 22-001 to provide guidance to Staff on the exercise of enforcement discretion when a specific or general licensee of an ISFSI does not comply with its design or licensing basis for protection against environmental conditions and natural phenomena.

Recent NRC inspections have concluded several licensees to be in noncompliance with their licensing basis during specific timeframes during ISFSI operations. This generally involves transp01t operations where a storage system is found to be in a configuration not explicitly evaluated by the CoC holder (cask lid removed during placement of a canister into an overpack, for example).

EGM 22-001 allows for enforcement discretion only if a licensee meets several conditions, one of which is (item #3.b) For a general license -within six months of the issuance date of this EGM, request the certificate holder for a spent fuel storage cask design to submit a Coe amendment request, and adopt the amendment, if approved by the NRC, through a Patt 72.212 evaluation; or; (item #3.c) implement physical design modifications and/or perform evaluations or analysis that demonstrates that SSCs important to safety are designed to withstand the effects of natural phenomena, including tornadoes and tornado-generated missiles.

All spent nuclear fuel at Dominion Energy Kewaunee (DEK) is in d1y storage at the ISFSI.

following conditions, which could affect DEK in the future, be considered by NAC during your evaluation of items 3.b and 3.c. of the EGM:

1. Future performance of required aging management inspections in supp01t of CoC 1031 license renewal. It is anticipated that during performance of these inspections, MAGNASTOR casks may be place in a configuration not yet specifically analyzed, e.g.

with cask lid removed.

2. Future removal of MAGNASTOR canisters from their overpacks for transp01t off-site.
3. Possible removal of a MAGNASTOR canister from its overpack due to a beyond-design-basis event that breaches or otherwise renders inoperable an overpack (dry transfer).

Should NAC determine to submit a CoC amendment request (item #3.b), in order to allow sufficient time to incorporate resulting changes in a quality manner, we request that NAC work with NRC to provide its general licensees a maximum 180-day period after the effective date of the revised amendment during which we can complete incorporation of the revised amendment.

CEG intends to comply with EGM 22-001 action 3.b, "for a general licensee - within six months of the issuance date of this EGM, request the certificate holder for a spent fuel storage cask design to submit a CoC amendment request, and adopt the amendment, if approved by the NRC, through a Part 72.212 evaluation." Alternately, based on ongoing discussions with NRC concerning the use of administrative controls for short term outdoor activities, other actions may be taken as deemed appropriate by the NRC in order to comply with the requirements of the EGM.

CEG requests NAC to complete the technical and licensing actions needed to address the requirements of EGM-22-001 in a timely manner. A 90-day response with a plan for addressing this issue is requested.

November 22, 2022 NAC International, Inc Page 2 of 2 CEG intends to implement the revised CoC for the MAGNASTOR system, CoC No. 1031, and FSAR, at the Three Mile Island Nuclear Station, Unit 1, (TMI-1), after approval from the NRC has been received. Implementation will be completed in a timely fashion after approval.

System user personnel shall use this information to prepare the detailed, site-specific procedures for loading, handling, storing, and unloading MAGNASTOR. Users may add, delete, or change the sequence of specific steps of the procedures to accommodate site-specific requirements provided that the general order of the tasks associated with TSC closure and storage is preserved and that the specific requirements for fastener torque values, temperature limits for operations, and other defined values in the procedure are also met.

Specific optional operational sequences are identified herein to facilitate the fuel loading operations.

All facility-specific procedures prepared by users must fully comply with the MAGNASTOR Certificate of Compliance (CoC) and Technical Specifications, including the approved contents and design features.

Equipment and operating requirements will be established by the user prior to implementation.

Refer to Table 9.1-1 for a listing of the major auxiliary equipment generally required by the user to load and close or to open and unload the system. MAGNASTOR provides effective shielding for operations personnel; however, the licensee/user may utilize supplemental shielding to further reduce operator radiation exposure. The planned location, type, and possible interactions of the temporary supplemental shielding with MAGNASTOR shall be appropriately evaluated by the licensee/user. MAGNASTOR, when operated by properly trained personnel in accordance with the generic procedures provided herein, will meet As Low As Reasonably Achievable (ALARA) guidance for personnel exposure control.

MAGNASTORs design features minimize the potential for contamination of the TSC during fuel loading, canister preparation, and transfer. The TSC is loaded in the spent fuel pool, but the external surfaces of the canister are protected from contact with the contaminated pool water by clean water maintained in the annulus between the transfer cask and the TSC. For purposes of the operating procedures, clean water is defined as demineralized, processed, or filtered pool water, or any water external to the spent fuel pool that has water chemistry compatible for use in the spent fuel pool. During loading and/or cooling operations, the exterior surfaces of the TSC shell, bottom and closure lid can be exposed to spent fuel pool water, which may be contaminated. The smooth exterior surfaces of the TSC shell, bottom and closure lid can be readily decontaminated. Therefore, the TSC external surfaces are expected to be essentially free of removable contamination during long-term storage operations.

MAGNASTOR System FSAR November 2022 Docket No. 72-1031 Revision 22E Tables in Chapter 3 provide the handling weights for the major components of MAGNASTOR and the loads to be lifted during various phases of the loading and unloading operations.

Licensees/users must perform appropriate reviews and evaluations to ensure that the lifted loads do not exceed rated load limits of user-supplied lifting equipment and comply with the facilitys heavy-load program.

Additional details and guidance on the operations of the MAGNASTOR System are provided in the MAGNASTOR Operations Manual, Document No. 71160-P-02, (or equivalent site-specific manuals prepared for individual Licensees/Users), including more detailed step-by-step operating procedures, and identification of Contingency Events and proposed corrective actions to ensure that FSAR and Technical Specification limits are not exceeded. Section 9.1 of this chapter includes several example contingency events and corrective actions which are addressed in notes and caution statements. Guidance applicable to specific loading patterns and equipment configurations are included in the MAGNASTOR Operations Manual or equivalent site-specific manual prepared for individual Licensees/Users. The Operations Manual also contains additional information on the system design description, characteristics, ancillary equipment design and functions, and operational figures of the ancillary systems.

At the option of the MAGNASTOR user and prior to the beginning of ISFSI handling operations, as defined below, general licensees may implement administrative controls to preclude conducting operations during periods of adverse weather. The administrative controls shall include at a minimum; establishing safe condition and forecast, as defined below where there are no adverse weather warnings, watches, and advisories for the oncoming 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br />.

Additionally, the administrative controls shall include compensatory measures to place important to safety structures, systems, and components in an analyzed condition if the safe condition and forecast can no longer be met.

  • ISFSI Handling Operations - All activities (including aging management inspections) associated with the lifting, placement, and movement of a loaded transportable storage canister, vertical concrete cask, or other structures, systems, and components important to safety.
  • Safe Condition and Forecast - A safe condition and forecast is considered to be the absence of tornado and severe thunderstorm watches, tornado and severe thunderstorm warnings, hazardous weather outlook indicating a moderate or high risk of severe thunderstorms or where the predicted wind speeds would qualify for a severe thunderstorm watch (58 mph or greater) for the oncoming 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br />. Weather forecasts will be accessed from the NOAA Weather Forecast Office nearest to each ISFSI.
