On September 13, 2022, the U.S. Nuclear Regulatory Commission staff met with Xcel Energy Company (Xcel) for an environmental pre-application discussion regarding Xcels future submittal of a subsequent license renewal application for the Monticello Nuclear Generating Plant. This was an Observation Meeting in which attendees had the opportunity to observe the NRC performing its regulatory function or discussing regulatory issues. Attendees had the opportunity to ask questions of the NRC staff or make comments about the issues discussed following the business portion of the meeting.

Purpose of the Meeting(s):

NRC met with Xcel Energy to discuss the preparation of the environmental report (ER) for the subsequent license renewal (SLR) application for Monticello Nuclear Generating Plant (Monticello or MNGP). This is the second pre-application public meeting that is a follow-up meeting of the first meeting on March 15, 2022 (ML22084A385).

General Details:

The NRC staff held a public (observational meeting) with the applicant to discuss the preparation of a Monticello SLR ER by Xcel Energy, in the form of a webinar, on September 13, 2022, 4:00 pm to 5:00 pm. The meeting was attended by (a) NRC staff members from Rulemaking Environmental Financial Support division and Division of New and Renewed Licenses and (b) Xcel Energy SLR personnel and supporting related personnel, and industry observers. No members of the public were identified during the meeting. Staff conducted the pre-application public meeting, in accordance with 10 CFR 51.40 Consultation with NRC staff.

Summary of Meeting:

The meeting began with introduction of the NRC and Xcel Energy staff, followed with an Xcel Energy presentation (ML22255A216):

Effect of February 24, 2022, NRC Memoranda and Orders on MNGP SLR ER content:

- The Commission determined that the Generic Environmental Impact Statement (GEIS) for license renewal does not specifically apply to SLR applications

- The Commission provided applicants the option of proceeding in site-specific manner to address the topics no longer addressed for SLR in the GEIS.

T. Smith Staff provided comments on the two examples provided by the applicant. Below is the summary of the comments:

The Commission has determined that the 2013 GEIS; NUREG1437, Revision 1, ML13106A241) does not apply to SLR. Therefore, Monticello subsequent license renewal application (SLRA) must address each license renewal issue on a site-specific basis regardless of whether the 2013 GEIS identifies these issues as generic (Category

1) or site-specific (Category 2). The NRC staff will also address each license renewal issue site-specifically in its environmental impact statements for SLR until the ongoing GEIS revision and associated rulemaking that address SLR is completed.

Staff stated that the level of detail, analysis, and justification provided in Monticello SLRA for generic issues (e.g., those identified as Category 1 issues for Monticello initial License Renewal (ML060190072) should be comparable to site-specific license renewal issues (e.g., those identified as Category 2 issues for Monticello initial License Renewal).

Staff stated that applicants should make site-specific conclusions for each license renewal issue regardless of whether these issues are categorized as Category 1 or 2 in the 2013 GEIS. Staff clarified that while it is acceptable to reference discrete information presented the 2013 GEIS, the associated conclusions for Category 1 issues cannot be relied upon for SLR.

The process of analysis adopted in the 2013 GEIS may be used to conduct impact analysis of previously defined Category 1 issues with site-specific information, to address environmental impacts for the subsequent license renewal term. This site-specific analysis needs to be independent of the findings or conclusions reached in the 2013 GEIS. The findings of this independent assessment may or may not reach the same conclusions (i.e., SMALL) as those described in the 2013 GEIS, for those issues, and need to be supported by appropriate level of discussion (e.g., appropriate level of site-specific details and justification) to clearly demonstrate/bolster independently (i.e.,

to show a bright line) that the Monticello ER findings or conclusions are not relying on the 2013 GEIS findings or conclusions of SMALL impacts.

Staff stated that the term new and significant is specific to Category 1 issues as identified in the 2013 GEIS (new and significant information definition excerpts from the NRC Supplemental Environmental Impact Statements (SEISs) are listed below).

However, since the 2013 GEIS only applies to an initial License Renewal, Monticello SLR ER should include new information regardless of its significance. In other words, Monticello SLR ER should provide the necessary information and data to reach site-specific impact determinations of SMALL, MODERATE, or LARGE [definitions are listed in ML060190072], as a result of SLR.

Excerpts from GEIS and SEISs:

The 2013 GEIS states: If the comments are determined to provide new and significant information that could change the conclusions in the GEIS, these comments will be considered and addressed in the SEIS.

T. Smith The term new and significant information that warrants notification to the Commission is defined in NRC SEISs as:

- New and significant information is (1) information that identifies a significant environmental issue not covered in the GEIS and codified in Table B-1 of 10 CFR Part 51, Subpart A, Appendix B or (2) information that was not considered in the analyses summarized in the GEIS and that leads to an impact finding that is different from the finding presented in the GEIS and codified in 10 CFR Part 51, or

- Significance indicates the importance of likely environmental impacts and is determined by considering two variables: context and intensity. Context is the geographic, biophysical, and social context in which the effects will occur. Intensity refers to the severity of the impact in whatever context it occurs.

The NRC expects to issue a draft GEIS revision that addresses SLR in February 2023.

The draft will be available for public review and comment.
