On March 15, 2022, the U.S. Nuclear Regulatory Commission staff met with Xcel Energy Company for an environmental pre-application discussion regarding Xcel Energys future submittal of a subsequent license renewal application for Monticello Nuclear Generating Plant.

Webinar Type of Meeting: This was an Observation Meeting in which attendees had the opportunity to observe the U.S. Nuclear Regulatory Commission (NRC) performing its regulatory function or discussing regulatory issues. Attendees had the opportunity to ask questions of the NRC staff or make comments about the issues discussed following the business portion of the meeting.
Purpose of the Meeting(s): NRC met with Xcel Energy Company (Xcel Energy) to discuss the preparation of the environmental report for the subsequent license renewal application (SLRA) for Monticello Nuclear Generating Plant (Monticello or MNGP).
General Details:
The NRC staff held a public (observational meeting) with the applicant (Xcel Energy) to discuss the preparation of a Monticello subsequent license renewal application by Xcel Energy, in the form of a webinar, on March 15, 2022, 1:00 pm to 3:00 pm. The meeting was attended by (a)
NRC staff members from the Division of Rulemaking Environmental Financial Support (REFS) and the Division of New and Renewed Licenses (DNRL) and (b) Xcel Energy license renewal personnel and supporting related personnel. Staff conducted the pre-application public meeting, in accordance with Title 10 of the Code of Federal Regulations Part 51.40 Consultation with NRC staff.
Summary of Meeting:
The meeting began with introduction of the NRC and Xcel Energy staff, followed with an NRC presentation (Agency Document Access and Management System (ADAMS) Accession No. ML22067A067): (a) Introduction and Purpose, (b) Subsequent License Renewal (SLR)
Overview, (b) Environmental Review Overview, (c) Environmental Review - Resource Areas, (d)
Discussion and Question, and (e) Public Participation. Next, Xcel Energy provided its presentation (ML22068A122) that included the following discussion items:
Regulatory Permits/Authorizations: Coastal Zone Management Act, Clean Water Act (CWA) 401 Certification, MPCA [Minnesota Pollution Control Agency]/NPDES [National Pollutant Discharge Elimination System], CWA 316(a) and 316(b)
Consultations & Public Communications: Consultations with agencies and Native American Tribes will occur and all received responses will be included in the SLRA ER

T. Smith Critical Habitat: No designated critical habitat is listed for Sherburne or Wright counties
Essential Fish Habitat: No essential fish habitat (EFH) is located within the vicinity of MNGP, nor were any EFH areas protected from fishing
Habitat Areas of Particular Concern (HAPC): No HAPC located within the six-mile vicinity of MNGP
Threatened and Endangered Species: Three Federally listed threatened, endangered or candidate species are listed within Sherburne and Wright Counties; twenty-two state listed species are located within Sherburne and Wright counties.
Cultural Resources: The MOSAP and State Historic Preservation Office (SHPO) databases list no cultural resources within the MNGP site
Lessons learned from previous relevant projects (license renewal and SLR)
Discussion Regarding the Recent Orders:
(a) February 24, 2022 NRC Memorandum and Orders and SECY-21-0066 (b) Xcel Initial Thoughts on Strategy
- Xcel will provide staff needed information in the ER and will have additional discussion meeting(s) with staff.
The meeting ended with the phone line opened for the public to speak. Rani Franovich spoke for the Breakthrough Institute, providing a comment that meeting(s) with the applicant regarding the February 24, 2022, NRC Memorandum and Orders and SECY-21-0066 (ML20364A007), as was proposed by the applicant during the public meeting and listed in the applicant slide, should be public meeting(s). Staff expressed appreciation for the comment and committed to provide the comment to the NRC management/leadership team for consideration.
NRC staff and the applicant discussed on a wide range of topics, including: status of compliance (Endangered Species Act, Clean Water Act, Historical Preservation Act, etc.), SAMA, and Tribal consultation. The applicant intends to submit its application in the first quarter of calendar year 2023.
Specifically, staff provided the following comments:
For postulated accidents, the Staff emphasized the importance of providing specific values for internal and external event Core Damage Frequency or the screening process used to determine the potential environmental impacts related to postulated severe accidents or that could affect the results of a previous SAMA analysis. These numbers are necessary for the NRC staff to make a comparison to the generic values or considerations in the 2013 Generic Environmental Impact Statement, as well as the values presented in the Supplemental Environmental Impact Statement for the initial license renewal.
Regarding historic and cultural resources, the NRC staff emphasized the importance of early contact and communication with the SHPO by Xcel Energy prior to submitting the subsequent license renewal application to the NRC. Regarding Clean Water Act Section 401 certification, the NRC reminded Xcel Energy that an applicant (in this case, Xcel Energy) for a Federal license to conduct activities that may cause a discharge of regulated pollutants into navigable waters would need to provide the licensing agency (in this case, the NRC) with a water quality certification from the State.

Comment: Breakthrough Institute requested that meeting with the applicant about the February 24, 2022, Commission order and staff requirement memorandum, regarding subsequent license renewal, should be a public meeting.
