COMPLETION OF REVIEW OF FRAMATOMES TRIENNIAL UPDATE TO DECOMMISSIONING FUNDING PLAN - ENTERPRISE PROJECT IDENTIFIER L-2021-DFA-0000

Dear Timothy Tate:

By letter dated November 16, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML21293A253), the U.S. Nuclear Regulatory Commission (NRC) approved the financial information in the update to your 2021 Framatome Decommissioning Funding Plan (DFP). However, the approval of the DFP indicated that there were two discrepancies to correct before the NRC review was completed. These discrepancies were as follows:

A. the total amount needed for the financial assurance instrument needed to be corrected, and B. the signature of the Framatome corporate representative needed to correspond to the 2021 information.

The NRC staff received your update to the DFP, E10-05-001, by letter dated May 12 ,2022, (ML22132A295). This version of the DFP included the correct total amount needed for financial assurance as well as the signature from your corporate officer corresponding with the information provided in your 2021 DFP submittal dated August 12, 2021 (ML21166A200). Our financial review team identified that they have the signed original documents.

The NRC staff has completed its review of the 2021 triennial DFP. The NRC staff has determined that the updated DFP is acceptable and, therefore, is approved. This letter closes all efforts under Enterprise Project Identification No. L-2021-DFA-0000.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR), or from ADAMS. The PDR is open by appointment only. You may submit your request to the PDR via email at PDR.Resource@nrc.gov or call 1-800-397-4209 between 8:00 a.m. and 4:00 p.m. (EST), Monday through Friday, except Federal holidays.
