WESTINGHOUSE ELECTRIC COMPANY, LLC - RENEWAL OF MATERIALS LICENSE SNM-1107 (ENTERPRISE PROJECT IDENTIFIER L-2017-RNW-0016)

Dear Patrick Donnelly:

Westinghouse Electric Company, LLCs (WEC) applied for a renewed license in an application dated September 20, 2021, as supplemented by letters dated February 21, 2022, March 15, 2022, and March 21, 2022. The U.S. Nuclear Regulatory Commission (NRC) staff reviewed the information in the application and documented the results of its review in the enclosed safety evaluation report (SER). In the SER, the NRC staff found that the information in the license application meets the requirements of Title 10 of the Code of Federal Regulations (10 CFR) and is acceptable. Based on its review, pursuant to Part 70 of Title 10 of the CFR, Materials License SNM-1107 is hereby renewed for a period of 40 years, expiring on September 12, 2062.

To inform the issuance of this renewed license, the NRC staff considered the information in the environmental impact statement (EIS) concerning the Columbia Fuel Fabrication Facility. The notice of availability of the EIS was published in the Federal Register on August 5, 2022 (87 FR 48044).

The renewed license contains several new or modified license conditions from the previous license as described below. Additional information may be found in Enclosure 1, Safety Evaluation Report-Renewal of License SNM-1107 for Westinghouse Electric Company LLC, Hopkins, South Carolina Docket Number 70-1151.

  • The Safety Condition S-1, from the previous license, was revised to include applications and letters submitted since the last renewal.

Documents transmitted by this letter contain Official Use Only - Security-Related Information. When separated from Enclosures 2 and 4, this letter and Enclosures 1 and 3 are decontrolled.

  • The Safety Condition S-3 was removed because the exemption from the requirement in the Site Emergency Plan to conduct annual audits of WECs emergency plans is no longer needed. The staff had granted the exemption to minimize personnel exposure during COVID, and WEC has resumed conducting the audits on an annual frequency.

(See Enclosure 1, Section 14.3.2.6).

  • Safety Condition S-5, from the previous license, has been removed. Based on the evaluations made by the NRC staff and Region II inspection staff, the staff determined that this license condition is no longer necessary for reasonable assurance of adequate protection against credible criticality hazards (see Enclosure 1, Section 5.3.2.5).
  • Safety Condition S-4 was added to provide a process for WEC to make changes to commitments in the license application. This process is consistent with the process for making changes in accordance with 10 CFR 70.72, Facility changes and change process (see Enclosure 1, Section 14.3.1.1).
  • Safety Condition S-15 was added to document WECs commitment (LRA Section 3.8) to develop a Corrective Action Program, in accordance with programmatic elements found in Section C of Regulatory Guide 3.75, Corrective Action Program for Fuel Cycle Facilities (see Enclosure 1, Section 11.3.7).
  • Safety Condition S-16 was added to inform and facilitate the NRCs oversight of WECs corrective actions for significant environmental contamination (see Enclosure 1, Section 9.3.2.3).
  • Safety Conditions S-17 and S-18 were added to inform and facilitate the NRCs oversight of environmental sampling and monitoring activities as a result of the Consent Agreement between WEC and the State of South Carolina Department of Health and Environmental Control. These license conditions provide an opportunity for the NRC to review and approve the WEC environmental monitoring and sampling program on two defined occasions (see Enclosure 1, Section 9.3.2.3).
  • The Safeguards Condition SG-1.1 was updated to include NRC review of revision 44 of the Fundamental Nuclear Material Control Plan for the Columbia Fuel Fabrication Facility, dated July 9, 2019 (see Enclosure 1, Section 12.3.1).
  • In the Safeguards Conditions in Section 3.0 of the license, International Safeguards, the NRC staff consolidated the previously existing SG Conditions SG-3.1.1 through 3.1.7, including incorporating new standardized language to meet international safeguards obligations (see Enclosure 1, Section 12.3.2).

Enclosed are copies of the public and non-public versions of Materials License SNM-1107 and the safety evaluation report. Notice of this renewal will be published in the Federal Register.

Enterprise Project Identifier L-2017-RNW-0016 is considered closed.
