AEROTEST OPERATIONS, INC. - ACCEPTANCE OF REQUESTED LICENSING ACTION RE: AMENDMENT TO APPROVE THE AEROTEST RADIOGRAPHY AND RESEARCH REACTOR DECOMMISSIONING PLAN (EPID L-2021-LLN-0004)

Dear Dr. Slaughter:

By letter dated July 20, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21230A304), as supplemented by letter dated January 20, 2022 (ADAMS Accession No. ML22025A200), Aerotest Operations, Inc. (AO) submitted a license amendment request to the U.S. Nuclear Regulatory Commission (NRC) for approval of the Decommissioning Plan (DP) for the Aerotest Radiography and Research Reactor (ARRR).

These submittals were made pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.82, Termination of license, paragraph (b)(1), which requires AO to apply for license termination within 2 years of permanently ceasing operations and that each application for termination of a license be accompanied or preceded by a proposed DP.

By letter dated January 12, 2022 (ADAMS Accession No. ML21307A324), NRC described that the DP for the ARRR provided technical information in sufficient detail to enable the staff to begin its detailed technical review to make an independent assessment regarding the acceptability of the DP in terms of the protection of public health and safety and the environment. However, supplemental information was requested for AO to apply for a license amendment, pursuant to 10 CFR 50.82(b)(5), to terminate the ARRR license, and a revised oath or affirmation to meet the regulatory requirements for requests for license termination.

The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staffs detailed technical review by separate correspondence.April 11, 2022 D. Slaughter 2 Based on the information provided in your submittal and discussions during the Decommissioning Plan pre-licensing meeting on January 12, 2022, the NRC staff has estimated that this licensing request will take approximately 250 hours0.00289 days <br />0.0694 hours <br />4.133598e-4 weeks <br />9.5125e-5 months <br /> to complete. The NRC staff expects to complete this review in approximately 8.5 months, which is December 2022. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.

These estimates are based on the NRC staffs initial review of the application and they could change, due to several factors including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS).
