SAN ONOFRE NUCLEAR GENERATING STATION, APPLICATION ACCEPTANCE: PROPOSED EXEMPTION FROM TITLE 10 OF THE CODE OF FEDERAL REGULATIONS PART 72.106(b), INDEPENDENT SPENT FUEL STORAGE INSTALLATION CONTROLLED AREA BOUNDARY (L-2021-LLE-0056)

Dear Mr. Bates:

On December 16, 2021, Southern California Edison (SCE) submitted a request (Agencywide Document Access and Management System (ADAMS) Accession No. ML21355A242 (Pkg)) for an exemption from a requirement of Title 10 of the Code of Federal Regulations (10 CFR) Part 72.106(b) for the San Onofre Nuclear Generating Station (SONGS) Independent Spent Fuel Storage Installation (ISFSI). In the request, SCE states that it wishes to establish the ISFSI Control Area Boundary at or within the site boundary which coincides with well-controlled physical boundaries that in some places are less than the required 100 meters from the ISFSI.

Specifically, SCE indicated that those areas that would be less than 100 meters would be the North Industrial Area seawall to the west of the ISFSI and the Owner Controlled Area fence line to the East of the ISFSI. On February 28, 2022, SCE submitted supplemental information (ADAMS Accession No. ML22062B028) in response to January 26, 2022, U.S. Nuclear Regulatory Commission (NRC) request for supplemental information (ADAMS Accession No. ML22018A313).

The NRC staff has reviewed your application and supplemental information and has determined that the application is accepted for detailed technical review. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

The NRC staff expects to complete the exemption review no later than October 31, 2022 (approximately 450 hours0.00521 days <br />0.125 hours <br />7.440476e-4 weeks <br />1.71225e-4 months <br />). In addition, the NRC, through its contractor, Oak Ridge National Laboratory (ORNL), will be performing a confirmatory analysis before the NRC staff completes its safety evaluation. The cost for the confirmatory survey will be approximately $90,000.

If there are emergent complexities or challenges in our review, such as, multiple rounds of requests for additional information, or unanticipated addition of scope to the review that would cause changes to the initial forecasted completion date, findings of our technical review, urgent
