SAN ONOFRE NUCLEAR GENERATING STATION - ISSUANCE OF EXEMPTION FROM THE 100 METER REQUIREMENT IN TITLE 10 OF THE CODE OF FEDERAL REGULATIONS, PARAGRAPH 72.106(B), REGARDING THE INDEPENDENT SPENT FUEL STORAGE INSTALLATION CONTROLLED AREA BOUNDARY (L-2021-LLE-0056)

Dear Albert Bates:

On December 16, 2021, Southern California Edison (SCE) submitted a request (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML21355A245), as supplemented on February 28, 2022 (ML22062B028), and September 29, 2022 (ML22277A016), to the U.S. Nuclear Regulatory Commission (NRC) for an exemption from a requirement of paragraph (b) of Section 72.106, Controlled area of an

[independent spent fuel storage installation] ISFSI or [monitored retrievable storage installation]

MRS, of Title 10 of the Code of Federal Regulations (10 CFR), for the San Onofre Nuclear Generating Station (SONGS) Independent Spent Fuel Storage Installation (ISFSI).

In the request, SCE states that it wishes to establish the ISFSI Controlled Area Boundary (CAB) at or within the site boundary, which coincides with physical boundaries that in some places are less than the 100 meters from the ISFSI required by 10 CFR 72.106(b). Specifically, SCE indicated that the areas that would be less than 100 meters from the ISFSI would be the North Industrial Area seawall to the west of the ISFSI and the Owner Controlled Area fence line to the east of the ISFSI.

The NRC has determined that, under the provisions of 10 CFR 72.7, Specific exemptions, the exemption is authorized by law, will not endanger life or property or the common defense and security, and is otherwise in the public interest. Therefore, the NRC grants SCE an exemption from the 100 meter CAB boundary requirement in 10 CFR 72.106(b) for the ISFSI at SONGS.

The exemption authorizes the licensee to slightly reduce the SONGS ISFSI CAB as requested.

The environmental assessment and finding of no significance (EA/FONSI) were issued in the Federal Register on December 28, 2022 (87 FR 79910), and concluded the action of slightly reducing the SONGS ISFSI CAB would have no significant impact on the environment.

Accordingly, the exemption will be effective immediately. A copy of the exemption is enclosed and has been forwarded to the Office of the Federal Register for publication.
