B.1 BRIEF PROJECT TITLE AND WORK DESCRIPTION

(a) The title of this project is: Tec hnical Support for Component Integrity Assessments

(b) Summary work description: The objective of this task order is to obtain expert technical assistance services from the Contractor to support component integrity assessments. Support is needed in areas such as the app lication, maintenance, and development of computational tools and m ethodologie s for performing component integrity assessments. Support is also needed to analyze emerging issues and evaluate and deve lop codes and standards and other aspects of NRC 's regu lato ry framework related to component integrity.

B.2 CONSIDERATION AND OBLIGATION-COST-PLUS-FIXED-FEE ALTERNATE I

(a) The total estimated cost to the Government for fu ll performance of this contract is

$1,901,430 of which the sum of $1,781,770 represents the estimated reimbu rsable costs, and of which $119,660 represents the fixed-fee.

(b) There shall be no adjustment in the amount of the Contractor's fixed fee.

(c) The amount currently ob ligated by the Government with respect to this contract is $330,000,

of which the sum of $308,000 represents the estimated reimbursable costs, and of which

$22,000 represents the fixed-fee.

(d) It is estimated that the amount currently obligated will cover performance through 01/3 1/2021.

(e) This is an incrementally-funded contract and FAR 52.232-22 - "Limitation of Funds" applies.

(f) In accordance with FAR 52.216-8 - Fixed Fee, it is the po licy of the NRC to withhol d payment of fee after payment of 85 percent of the fee has been pa id in o rder to protect the Government ' s interest. The amount of fixed-fee withheld from the contractor will not exceed 15 percent of the total fee or $100,000, whichever is less. Accordingly, the maximum amount of fixed-fee that may be held in reserve is $17,949.

C.1 STATEMENT OF WORK

1. EWC TASK ORDER TITLE

Techn ical Support for Compo nent Inte g rity Assessments

2. BACKGROUND

The NRC's Office of N uclear Regulatory Re searc h (RES) provide s data, standa rd s, too ls, and methods to the NR C's regul atory offices to suppo rt their reviews of material performance relat ed li censing submittal s an d safe ty issues. The co nfirmatory re search on m ate rial s perfonnance focuses on both the dev e lopment of methodologies need ed to support regulatory act ions and the work sup portin g the technical bases for codes and standards dev e lopment. A common the me in th is work is a proactive a pproa c h to the management of age-related degradat io n due to mechanisms such as fatigue and stress-corrosion cracking. For examp le, to bette r under s tand how nuclear powe r plant components are influenced by the phenomenon of primary water stre ss-corros io n cracking (PWSCC), the NRC is focus in g research efforts on co ntinu ed deve lopme nt of a n alysis meth ods and co mput ation a l too ls. The NRC also is assess ing the impacts of PWSCC on the leak-before-break behavior of nuclear power plant piping sys tems.

Criterion 4, "Env ironmental a nd Dynamic Effects Design Bases," of Appendix A, "General Design Criter ia for Nuclear Power Plants, " to T it le 10 of the Code of Federal Regulations ( 10 CFR), Part 50, "Dom estic Licensing of Production and Ut iliza tion Faci lities," s tates, in p art, that th e dynamic effects assoc iated with postu lated reactor coo la nt system pipe ruptures may be exc lu ded from the de s ign basis whe n a naly ses that the NRC has reviewed and approved demon stra te that the probabi lity of fluid sys tem piping rupture is extremely low und er condition s consistent with the design basis fo r the piping. Licensees typically have demonstrated compliance with thi s prob abilis ti c criterion through de term ini stic a nd hi ghly conserva tive leak before-break ana lyses.

NUREG-0800, "Stan d ard R eview Plan fo r the Review of Safety Analysis R eport s fo r Nuclear Power Plants: LWR Edition," Section 3.6.3 [l] provid es gui dance for the NRC s taff' s review of licen see ana lyses s ubmitted in accordance with 10 CFR Part 50, Appendix A, Criterion 4.

NUREG-0800 Section 3.6.3 prec ludes the assessment of piping syste m s with act ive degradation mechani sms. Howeve r, it is known that PWSCC is occurring in sys tem s that have been granted prior NRC approval under 10 CFR Part 50, Appendix A, Criterion 4 to exclu de dynamic effec ts

associated with postulated reactor coolant system pipe rupture s from the des ign basis. Given advances in probabilistic methodologies, th e NRC staff and industry concluded that it was more appropriate to perform probabilist ic a naly ses of postulated reactor coolant sys tem pip e ruptures to fully address and quantify uncertaintie s and directly demonstrate compliance with the probabili st ic requirement s of I O CFR Patt 50, Appendix A, C riterion 4.

To develop the capability to perform the nece ssary probabili stic analyses, RES worked in collaboration with the Electric Power Re searc h Institute to develop a new computer code called "Extreme ly Low Probability of Rupttu*e" (xLPR). xLPR is a state-of-th e-a rt prob a bilistic fractur e m echanics code for piping applications. Code deve lopment was a multi-year effor t th at built on the results of a successful pilot study. The code was designed, built, and tested und er a ri go rou s software quality assurance program and pro vides regulators, industry, researchers, and the pub lic with n ew quantitative capab ilities to analyze th e risks associated with nucl ear power plant piping systems subject to degradation mechanisms. Core capabi lities of the code include modeling fatigue, stress-corrosion cracking, ins ervice inspection, ch em ical and mechanical miti gat ion, leak rates, and se is mi c effects.

As the initial regulatory application of xLPR Version 2.0 (V2.0), RES has used the code to study the imp acts of PWSCC in systems that have been gra nted p rior NRC leak-before-break a pproval under l 0 CFR Part 50, Appendix A, Criterion 4. These act iv ities in cl uded se nsi tivity st udies to identify which model s, sub-models, and types of input v ariab les contribute mo st significant ly to uncertainty in the res ults from the code. RES also used xL PR V2.0 to re-eva luate previous leak befo re-break ana ly ses for a s ub set of the c utTe nt fleet of p lants. The re-evaluations cons idered the impact s of PWSCC, fatigue, inservice ins pection, and mit igation to determine the trend in rupture frequencies and other metrics. With the completion of these activities, RES needs to complete re-evaluations of previous of leak-before-break ana lyses for the remaining plants in the fl eet. In ad dition, RES need s to co ns ider the res ults and assess cu rrent leak-befo re-brea k re gu lations and g uidance and, if applicable, make recommendation s for enhancement.

Beyond leak-before-break studies, th e xLPR code support s broader NRC efforts to further the use of probab ilistic fracture mechanic s ana lyses usin g state -of-the-art computational tools. To thi s end, RES ha s begun publicly di stributing the xLPR code with the goal of es tabli s h i ng a user group. Public avai lability of xLP R V2. l was announced in [2] and details about the code have b een presented in various NRC public meetin gs [3] and [4]. Publi c di s tribution a nd user group participation benefit s the NRC in several re spect s. For example, the broader user base : (a) exerc ises the code more thorou g hly than would be poss ible if use were limit ed to only NRC appl ications, (b) increases co nfide nce in the code's capab ilit y to accurately model indiv idual phenomena and system behavior over the required range of conditions, (c) reduces the level of effort requir ed by RES to e ns ure the validity of the code's results, and (d) leverages expe rt ise of the users as they identify code deficiencies and e rrors and propo se fixes. Publi c distribut ion is furth e r exp ected to increase u se of the xLPR code to suppo rt licen si n g actions and codes a nd standards development, and RES needs to maintain the necessary capabilities to support the r elated regulatory rev iews. In co ncert with these activ ities, suppo rt for conti nu ed maintenance a nd deve lopme nt of the xLPR code is ne cessa 1y to ensure its long-te1m usab il ity.

3. OBJECTIV E(S)

The objective of this task orde r is to obta in expert technical a ss istance se rvices from t he Co n trac tor to s upport com pon en t integrity assess m e nt s. Support is needed in ar eas su c h as the appli cation, m a inte nanc e, and d eve lopment of computatio na l tool s a nd m ethod o logies for perfonning compone nt integrity assessme nts. Support is also needed to ana lyze emer g ing iss ues and eva luate and de ve lop codes and standards and other aspec ts ofN R C's regulat01y framework r ela ted to component integrit y.

This req uir ement falls under Technical Su ppo1t Service Area (TSSA) 3.4, ent itled "Component Integ rity and Materia ls Pe r forma n ce."

4. STATEMENT OF WORK TASKS

Task 1: Ge n era li zation Study

The Contractor s hall use the xLPR code to st ud y the impact s of PWSCC fo r the ent ire fleet of U.S. press urized-wa te r react ors (PWR s) to det ermin e whether a ny changes are needed to curren t regula to ry requir eme nts a nd guid ance re lated to leak-befo re-brea k. The u se of other computational tools may be needed to develop inputs for or otherwise s upport the analyses p erfonn ed us in g the xLPR code. Spec ific activit ies include, but are not limit ed to, the following:

A. The Co n tracto r shall rev iew and categorize all PWR p ip in g syste m s previously appro ved for leak-before break. The goal o f this review and categori za tion is to reduce, to the exten t prac ti cal, the numb e r of analy ses that wi ll need to be p e rform ed.

B. The Contrac tor shall define the sp ecific analyses necessary to bound each category of

p1pmg system. Factors present in the PWR fleet, such as PWSCC mitigation techniques and inserv ice insp ec tion, shall be considered. Definition of the analyses may be an iterative proc ess, and the re sult s from prior stu die s s hould be used to infonn th is effort.

C. The Contractor sha ll determine and develop the inputs nece ssary to perform each of the analyses. Sources for inputs cou ld include the open literature, xLPR-re lated docum entation,

prior studies and ana lyses, and docketed correspondence avai la ble from both internal and external NRC ADAMS. The Contractor may also need to perform finite e lement ana lyses to deve lop we ld res idual s tress profil e input s. The Contractor shall promptly comm unicate any input gaps that it can not fill to th e COR.

D. The Conh*actor sha ll execute the analyses us ing the xLPR code. The Conh*actor shall compa re the res ults of these analyses against acceptance cr iteria identifi ed by t he COR.

E. Based on the results of the analyses, the Contractor sha ll prepare an assessment of c urrent reg ulato1y require me nts and gu ida nce related to leak-befo re-br eak. Recommendations for en hanc in g the se regulations and gu id ance s hall be provided as appropriate.

Task 1 Completion Date: The task s hall be completed by August 3 1, 2021.

Tas k 1 Deliverables: The Co ntractor s hall prepare an Analysis Plan fo r comp letion of this tas k.

The Analysis Plan shall, at minimum, include the categories of pipin g systems, analyses that will be p erfo rmed to bound each category, completion schedu le and sta tu s of each analysis, and any potential input gaps. The Contractor s hall s ubmit the Initial Ana lysi s Plan to the COR no later than 30 days afte r award of the task o rder. Thereafter, the Co ntrac tor sha ll maintain and update the Ana lysis Plan as ne eded until the task is comp le te. The Analysis Plan Updates shall be provided to the COR biweekly unti l the analyses are comp lete and incorporate any comments provided by the COR.

The Contractor sha ll su bmit information (e.g., code input and output files) from the analyses executed per th e Ana lysis Plan (as updated) as they are comp leted.

In addit ion, the Contractor shall prepare a Technica l Lette r Report (TLR) covering a ll work performed under thi s task. The Contractor s hall prepare the TLR in parallel with performing the analyses exec uted pe r the Ana lysis Plan (as updated). In -pro gress drafts of the TLR shall be s ubmitt ed to the COR monthly. The in-progress TLR draft s shall incorporate any comments provid ed by the COR on th e prev ious s ubmi ss ion. The Contractor s ha ll complete th e TLR after executing a ll the analyses in the Ana lysis Plan (as updated). The Contractor's completed T LR sha ll be submitted by March O 1, 2021.

Thereafter, the Co ntractor s hall s upport t he NRC staff s rev iew of the TLR. The rev iew will be completed in several stages and may take up 5 months to com plete. The COR will comm unicate

comments generated as a result of thi s review process to the Contractor. The Contracto r sha ll address all comments and pre pare interim update s to the TLR as necessary. Some comments may require the Contractor to perform add itional ana lyses to address. Interim updates to the TLR shall be provided to the COR biweekly during the review pro cess throu g h Jul y 31, 2021.

The Contractor shall finalize and su bmi t the TLR in a form ready fo r NRC publication by August 31, 2021.

Task 2: xLPR Code Main t enance, Development, and Technical Support

Task 2a - xLPR Code Maintenance and Development

As directed by the COR, the Contractor shall provide tec hnical assistance to s upport xLPR code m a inte nance and deve lopm ent needs. Maint e nance act iv ities includ e, but a re not limi ted to:

developing modifications to code-related products, such as the sourc e and exec utab le code, u ser manual, data librari es, configuration control documents, and other reference files and documents, to correct identified pro bl ems, impro ve performance o r ma inta inab ili ty, kee p the products usab le in a c ha nged o r c ha ng in g e nvi ro nm ent, and detect and co rrect latent fau lts. Maintenance ac ti vi ties also include, but are not limited to: (a) configuration management, ( b) documenting,

tracking, and proce ssing maint e nanc e requests, ( d) p erforming tes ting necessary to en s ure prop er functionality of the code fo ll ow in g maintenance-related changes, and (e) electron ic storage of file s. Development activities incl ud e modifications that s ig nificantly expand the functional capabil ities of the xLPR code.

A ll m ai ntenance and development act ivities sha ll be perfo rm ed in acco rd ance wit h the xLPR Software Maintenance Plan, as may be revised from time-to-tim e, and any implementing procedur es as directed by the COR. In addition, a ll Contractor p erso nnel invo lved in maintaining o r developing th e xLPR code sha ll receive training as s pecified in th e xLPR Software Maintenance Plan a nd participate in a ny other su pplem enta l training as directed by the COR. The Contrac tor shall coordinate its maintenance and dev e lopment activities w ith oth er code maintainer s as directed by the COR. It also may be necessary or advantageous for the Contractor to prepare, deliver, and maintain e lectroni c sys te m s to su p po rt t he effective and efficient performance of the maintenance and development act ivities. Such systems sha ll be implemented as approved by the COR.

Task 2b - xLPR Code Technical Support

Under th is tas k, the Contracto r shall provide a broad range of tec hni cal ass is tance su pport related to the xLPR code and its vario u s a pplications. It includes suppor t for the NRC staff, general ana ly sis and technical s uppo rt, and support to build the commun ity of public xLPR code use rs.

Upo n request, the Contrac tor shall assist users from the NRC staff with prope r use of the code.

Support may include, but is not limited to, areas such as:

and other appropriate code grou ps, as instructed by the COR. Some of the issues of importance presented at the committee meetings pertain to aging effects and component integrity iss ue s. In addit ion, it i s anticipated th at new development s and result s obtain ed u s ing th e xLPR code (e.g.,

new code cases) w ill be introduced to the ASME B&PV committees. Technical support is needed so that the NRC staff may adequate ly unders tand the technical and regulatory iss ue s assoc iated with re lated code act ions so th at it m ay vote appropriately. Accordingly, the Co ntractor s hall prepar e for, attend, and prepare a summ ary of the topic s, di scu ssions, an d any presentation s given at the regular ASME B&PV code meetings. As directed by the COR, the Contractor s hall a lso provid e s upport outs ide of the regular code me e ting s. If the contracto r performs material testing, the Draft TLR shall also includ e thorough de sc ription s of any material tes ting p e rform e d und e r this task, includ in g test procedure s and matrices, and a ll test re sult s. The contractor shall also provide any test results in their raw data form and in Excel. The contractor sha ll prepare a Final TLR incorporat in g any comments on the Draft TLR from the COR. The COR will review all draft deliverables (and coordinate any inte rnal NRC staff review, if needed) and provide comments back to the contractor. The Contractor shall revi se the draft deliverable based on th e comments pro v ided by the COR and then deliver a revised version of the deliverable, which will then b e considered the F ina l Versio n. More than one round of drafts may be needed if the Contractor does not successfully incorporate the COR's comments on the previous draft.

The Contractor's investigator( s) may publi sh the r esult s of this work in the open literature or may present papers at publ ic or assoc iation meeting s at int erim stages of the wo rk if the artic le or paper has been reviewed by the COR in draft form and agreement has been reached on the content. Submit the work in final fo rm to the COR, accompanied by NRC Form 390A, " Release to Publi sh Unclassified NRC Contractor Speeches, Pre sen tation s, Paper s, and Journal Articles."

H.1 CONTRACTOR CONDUCT (APRIL 2020)

Th e contractor will ensure that all contractor staff receive anti-harassment training before be ing granted facility access. The Government reserves the right to deny or restrict fac ility access for any Contractor employee who engages in any conduct that the agency believes adversely affects the work p lace. The imposition of a restriction or prohibition shall not excuse the Cont ractor from performa nce of ob ligat ions under the cont ract.

H.2 SECURITY REQUIREMENTS RELATING TO THE PRODUCTION OF REPORTS OR THE PUBLICATION OF RESULTS UNDER CONTRACTS, AGREEMENTS, AND GRANTS (JUL 2016)

Review and Approval of Reports

(a) Reporting Requirements. The contractor/gran tee shall comply with the terms and conditions of the contract/grant regarding the contents of the draft and final report, summar ies, data, and related documents, to include correcting, deleting, ed iting, revising, modify ing, formatting, and supplementing any of the information contained therein, at no additiona l cost to the NRC.

Performance under the cont ract/grant will not be deemed accepted or completed until it comp lies with the NRC's direc tions, as appl icab le. The reports, summaries, data, and related documents will be considered draft until approved by the NRC. The contractor/grantee agrees that the direction, determinat ions, and decisions on approva l or disapproval of reports, summaries, data, and related documents created under th is con tract/grant remain so le ly within the discretion of the NRC.

(b) Publication of Results. Prior to any dissemination, display, publication, or release of articles, reports, summaries, data, or related documents deve loped unde r the contract/grant, the contractor/grantee shall submit them to the NRC for review and approval. The contractor /

grantee shall not release, disseminate, display or pub lish articles, reports, summaries, data, and related documents, or the contents therein, that have not been reviewed and approved by the NRC for release, display, dissemination or pub lication. The contractor/g rantee agrees to conspicuous ly p lace any disc laimers, markings or notices, directed by the NRC, on any artic les, reports, summaries, data, and related documents that the contra c tor/grantee intends to release, display, disseminate or publ ish to othe r persons, the public, o r any other entities. The contractor/grantee agrees, and grants, a royalty-free, nonexclusive, irrevocab le worldwide licen se to the government, to use, reproduce, modify, distribute, prepare derivative works, release, display or disclose the artic les, reports, sum m aries, data, and related documents developed under the contract/grant, for any governmental purpose and to have or author ize others to do so.

(c) Identification/Marking of Sensitive Unclassified Non-S.afeguards Informat ion (SUNSI) and Safeguards Information (SG I ). The decision, determinat ion, or direction by the NRC that

information possessed, form ulated o r produced by the cont racto r/grantee consti tutes SUNSI o r SGI is so lely within the authority and discretion of the NRC. In performing the contract/grant, the contractor/g rantee shall clea rly m ark SUNSI and SG I, to include fo r exa m ple, QUO-A llega tion Informat ion or QUO-Sec u rity Re lated Information on any reports, documents, designs, data, mater ia ls, and wr itten informat ion, as d irected by the NRC. In add ition to marking the inform a tion as directed by the NRC, the co n tractor shall use the applicable N RC cover sheet (e.g., NRC Form 46 1 Safegua rds Information) in maintaining these records and documents. The contractor/grantee shall ensure that SUNSI and SG I is handled, main tained and protected from unauthorized disclosure, consisten t with NRC policies and directions. The contractor/g rantee sha ll comp ly w ith the requirements to mark, maintain, and protect all information, including documents, summar ies, reports, data, designs, and materials in accordance with the provisions of Section 147 of the Atomic Energy Act of 1954 as amended, its implementing regu lations (10 CFR 73.2 1 ), Sensitive Unclassified Non-Safeguards and Safeguards Informat ion policies, and NRC Managemen t Directives and Handbooks 12.5, 12.6 and 12.7.

(d) Remedies. In add ition to any civil, criminal, and contractua l remedies avai lab le under the applicable laws and regulations, failure to comp ly with the above provisions, and/or NRC directions, may resu lt in suspension, withhol ding, or offsetting of any payments invoiced or claimed by the contractor/grantee.

(e) Flowdown. If the contrac tor/grantee intends to en ter into any subcontracts or other agreements to perform this contract/grant, the contractor/grantee sha ll inc lude all o f the above provisions in any subcontracts o r ag reements.

H.3 WHISTLEBLOWER PROTECTION FOR NRC CONTRACTOR AND SUB C ONTRA CTOR EMPLOYEES

(a) The U.S. Nuclea r Regulatory Commission (N RC) contracto r and its subco n tractor a re subject to the Whistleb lower Employee Protection pub lic law provisions as codified at 42 U.S.C.

5851. NRC contractor(s) and subcontractor(s) shall comply with the requirements of th is Wh istleblower Employee Protection law, and the implement ing regulations of the NRC and the Department of Labor (DO L ). See, for example, DOL Procedu res on Handl ing Comp laints at 29 C.F.R. Part 24 concerning the emp loyer ob ligations, prohibited acts, DO L p rocedures and the requirement for p rominent posting of notice of Employee R ights at Appendix A to Part 24 entitled: "Your R ights Under the Energy Reorganization Act".

(b) Under this Wh istleblower Employee Protection law, as implemented by regulations, NRC contractor and subcontractor employees are protected from discharge, reprisal, threats, intimidation, coercion, black listing or other employment discriminat ion pract ices with respec t to compensation, terms, conditions or privileges of their emp loyment because the contractor or su bcontractor employee(s) has provided notice to the emp loyer, refused to engage in unlawful prac tices, assisted in proceedings or testified on activities concerning alleged viol ation s of the Atomic Energy Act of 1954 (as amended) and the Energy Reorganization Act of 1974 (as ame n ded).

(c) The contractor shall insert this or the subs tance of this c lause in any subcontracts i1nvo lv ing work performed under this con tract.

H.4 GREEN PUR C HASING (SEP 2015)

(a) In furtherance of the sustainable acquisition goals of Executive Order (EO ) 13693, "Planning for Fe deral Sustainability in the Nex t Decade," products and services provided under this contracVorder shall be energy efficient (EnergyStar or Federal Energy Management Program -

FEMP-designated products), water efficient, biobased, environmentally preferable (excluding EPEAT -registered products), non - ozone depleting, contain recycled content, or are non-or low toxic alternatives or hazardous constituents (e.g., non-VOC paint), where such products and services meet agency performance requirements. See : Executive Order (EO) 13693, "Planning for Federal Sustainability in the Next Decade."

(b) The NRC and contractor may negotiate during the contract term to permit the substitut ion or addition of designated recycled content products (i.e., Comprehensive Procurement Guidelines

- CPG), EPEAT -registered products, EnergyStar-and FEMP designated energy efificient products and app liances, USDA designated biobased products (Biopreferred program),

env ironmentally preferable products, WaterSense and other water efficient products, products containing non-or lower-ozone depleting substances (i.e., SNAP), and products containing non or low-toxic or hazardous c o n stituents (e.g., non-VOC pa int), when such products andl services are readily avai lable at a competitive cost and satisfy the NRC's performance needs.

(c) The contractor shall flow down this c lause into all subc ontracts and other agreements that relate to performance of this contracVorder.

(b) If one or more of the key personnel, for whatever reason, becomes, or is expected to become, unavailab le for work under this contract for a continuous period exceeding 30 work days, or is expected to devote substantial ly less effort to the work than indicated in the proposal or initially anticipated, the contractor shall immediately notify the contracting officer and shall, subject to the concurren c e of the contracting officer, promptly rep lace the personnel w ith personne l of at least substant ially equal abi lity and qua lifications.

(c) Each request for approva l of substitutions mu st be in writing and c ontain a detailed explanation of the circumstances necessitating the proposed substitutions. The request must also contain a complete resume for the proposed subst itute and other information requested or needed by the contracting officer to evaluate the proposed substitution. The contracting officer and the project officer shall evaluate the con tractor's request and the contracting officer sha ll promptly notify the contractor of his or her decision in writing.

(d) If the contracting officer determines that suitab le and timely replacement of key personne l who have been re a ssigned, terminated, or have otherwis,e b ec ome un a vaila ble for the contract work is not reasonab ly forthcom ing, or that the resultant reduction of productive effort wou ld be so substantia l as to impair the successfu l comp letion of the contract or the service order, the contract may be terminated b y the contracting officer for default or for the convenien ce of the

(b) Performance of the work under this contract is subject to the technical direction o f the NRC COR. The term "technical direction" is defined to include the following:

(1) Technical direction to the contractor which shifts work emphasis between areas of work or tasks, authorizes travel which was unanticipated in the Schedule (i.e., travel not co n templat ed in the Statement of Work (SOW) or changes to specific travel identified in the SOW), fills in details, or otherwise serves to accomplish the contractual SOW.

(2) Provide adv ice and guidance to the contractor in the preparation of drawings,

spec ificat ions, or technical portions of the work description.

(3) Review and, where required by the contract, approva l of technical reports, drawings, specifications, and technical information to be delivered by the contractor to the Government under the contract.

(c) Technical direction must be within the general statement of work stated in the contract. The COR does not have the authority to and may not issue any technica l direction which :

(1) Constitutes an assignment of work outside the general scope of the contract.

(2) Constitutes a change as defined in the "Changes" clause of this contract.

(3) In any way causes an increase or decrease in the total estimated contract cost, the fixed fee, if any, or the time required for contract performance.

(4) Changes any of the expressed terms, conditions, or specifications of the contract.

(5) Terminates the contract, settles any claim or dispute arising under the contract, or issues any unilateral directive whatever.

(d) All technical directions must be issued in writing by the COR or must be confirmed by the COR in writing within ten (10) working days after verbal issuance. A copy of the written direction must be furnished to the contracting officer. A copy of NRC Form 445, Request for Approval of Official Foreign Travel, which has received final approval from the NRC must be furnished to the contracting officer.

(e) The contractor shall proceed promptly with the performance of technical directions duly issued by the COR in the manner prescribed by this clause and within the COR's authority under the provisions of this clause.

(f) If, in the opinion of the contractor, any instruction or direction issued by the COR is within one of the categories as defined in paragraph (c) of this section, the contractor may not proceed but shall notify the contracting officer in writing within five (5) working days after the receipt of any instruction or direction and shall request the contracting officer to modify the contract accordingly. Upon receiving the notification from the contractor, the contracting officer shall issue an appropriate contract modification or advise the contractor in writing that, in the contracting officer's opinion, the technical direction is within the scope of this article and does not consti tute a change under the "Changes" clause.

(g) Any unauthorized commitment or direction issued by the COR may result in an unnecessary delay in the contractor's performance and may even result in the contractor expending funds for unallowable costs under the contract.

(h) A failure of the parties to agree upon the nature of the instruction or direction or upon the contract action to be taken with respect thereto is subject to 52.233-1 - Disputes.

(i) In addition to provi ding technical direction as defined in paragraph (b) of the section,

the COR shall:

(1) Monitor the contracto r's technical progress, including surveillance and assessment of performance, and recommend to the contracting officer changes in requirements.

(2) Assist the contractor in the resolution of techn ical problems encountered during performance.

(3) Rev iew all costs requested for reimbursement by the contractor and submit to the contracting officer recommendations for approval, disapproval, or su spens ion of payment for supplies and services required under this contract.

(4) Assist the cont ractor in obtaining the badges for the contractor personnel.

(5) Immed iately notify the Secur ity Branch, Division of Fac ilities and Security (SB/ DFS) (via e-mai l) when a contractor employee no longer requires access authorization and return of any NRC issued badge to SB/ DFS within three days after their terminat ion.

The Government may require continued performance of any services within the limits and at the rates specified in the contract.
