Dear Dr. Schuerman:

We have reviewed the proposed revisions to the Louisiana Department of Environmental Quality rules in the Louisiana Administrative Code, Title 33, Part XV, Radiation Protection, Chapter 7, Use of Radionuclides in the Healing Arts, and the final revisions to Sections 1510 and 1520 in Chapter 15, Transportation of Radioactive Material received by our office on August 17, 2021. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules, and the requirements included in Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2015-3, 2018-1, 2020-2, and other provisions not associated with a RATS ID (10 CFR Part 35.24(g), 35.404, 35.406, 35.410, 35.415, 35.2404, 35.2406, 35.2310, and 35.3045) as identified in the enclosed State Regulation Status (SRS) Data Sheet. These regulations were reviewed by comparison to the equivalent NRC rules as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on October 13, 2021.

As a result of our review, we have nine comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Louisiana regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Louisiana regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other Louisiana regulations, as indicated. Louisiana needs to make the change indicated above to meet the Compatibility Category B designation assigned to 10 CFR 35.50.

2 § 35.51 LAC Title 33, 2018-1 B Training for an authorized medical Part XV, physicist.

§763.J

1) In Section §763.J.2.b, the word and is included after the semicolon, which implies that the requirements in paragraph 3 are only applicable to those who meet the requirements in paragraph 2.b. However, the requirements in paragraph 3 are applicable to all medical physicists.

Louisiana needs to remove the word and after the semicolon.

2) In Section J.2.b, the reference to Paragraph J.3 does not correspond to

§35.57. Louisiana needs to change the wording to read, and Paragraph B of this Section to correspond to §35.57.

Louisiana needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 35.51.

3 § 35.55 LAC Title 33, 2018-1 B Training for an authorized nuclear Part XV, pharmacist.

§763.K Section §763.K.1 has an extra phrase which reads, and who meets the requirements in Subparagraph K.2.b of this Section. 10 Enclosure 1

Louisiana needs to remove this phrase to meet the Compatibility Category B designation assigned to 10 CFR §35.55.

4 § 35.57 LAC Title 33, 2018-1 B Training for experienced Radiation Safety Part XV, Officer, teletherapy or medical physicist,

§763.B Except for authorized medical physicist, authorized D: user, nuclear pharmacist, and authorized 35.57(a)(4) nuclear pharmacist.

and (b)(3)

Section §763.B.6.c provides the authorized use for the Board certified physician, but it only provides the use of sources for brachytherapy (§741).

Louisiana needs to add the authorized use for sealed sources in teletherapy units, remote afterloaders units, and gamma stereotactic radiosurgery units (§747), to meet the Compatibility Category B designation assigned to 10 CFR 35.57.

5 § 35.204 LAC Title 33, 2018-1 H&S Permissible molybdenum-99, strontium-Part XV, §732 82, and strontium-85 concentrations B and D Section §732 B states that the Mo-99 and Rb-82 extracts shall be measured, but it does not require compliance with limits in paragraph A.

Louisiana needs to add the requirement, to demonstrate compliance with paragraph A of this section to meet the Compatibility Category H&S designation assigned to 10 CFR 35.204.

6 § 35.290 LAC Title 33, 2018-1 B Training for imaging and localization Part XV, studies

§763.D In Section D.3.a.ii, the reference to Subclause D.3.a.ii.(g), does not correspond to §35.290(c)(1)(ii)(G).

Louisiana needs to change this requirement back to read, Subclause D.3.a.ii.(g) to 2

Louisiana needs to delete the word or to meet the Compatibility Category B designation assigned to 10 CFR 35.396.

8 § 35.491 LAC Title 33, 2018-1 B Training for ophthalmic use of strontium-Part XV, 90

§763.G.

Section 763.G.2.c. states that a preceptor could meet the equivalent requirements in

§§ 35.57 or, 35.490 AND 35.491.

Louisiana needs to revise this paragraph to omit the word and to read, Subsections B, F, G of this Section, or equivalent agreement state requirements., to meet the Compatibility Category B designation assigned to 10 CFR 35.491.

9 § 35.655(a) LAC Title 33, 2018-1 H&S Full-inspection servicing for teletherapy Part XV, §762 and gamma stereotactic radiosurgery units Section 762.A. states that inspections/service shall be done during each source replacement OR at intervals not to exceed five years.

Louisiana needs to revise this statement to replace the word or to and to meet the Compatibility Category H&S designation assigned to 10 CFR 35.655.
