The staff previously reviewed the Terrestrial Energy USA, Inc. (TEUSA) Applicability Assessment of the IMSR Core-unit in a document that concluded that Title 10 of the Code of Federal Regulations (10 CFR) Subpart 52.137, Contents of applications; technical information for a Standard Design Approval per Subpart E of 10 CFR Part 52 was applicable to the IMSR Core-unit. The NRC provided feedback in a letter dated January 27, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20302A488),
agreeing with TEUSAs assessment at the subpart level, but noting that not all items of the 10 CFR 52.137 subpart may apply to the IMSR Core-unit SDA application. In a letter dated December 14, 2020 (ADAMS Accession No. ML21014A351), TEUSA submitted a proprietary document titled Applicability Assessment - Comparison of Content Requirements of 52.137 and IMSR Core-unit which assessed the regulatory applicability of each item and subitem of 10 CFR 52.137. The staffs feedback on this document is below.
