PILGRIM NUCLEAR POWER STATION - ISSUANCE OF AMENDMENT TO REVISE THE PHYSICAL SECURITY PLAN TO INCORPORATE AN ADDITIONAL INDEPENDENT SPENT FUEL STORAGE INSTALLATION (EPID: L-2020-LLA-0070)

Dear Ms. Cowan:

The U.S. Nuclear Regulatory Commission (NRC) has issued the enclosed (enclosure 1)

Amendment No. 253 to Renewed Facility Operating License No. DPR-35 for the Pilgrim Nuclear Power Station (PNPS). The amendment is issued in response to Holtec Decommissioning International, LLCs (HDIs) application dated April 2, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20141L057 Pkg.), as supplemented by letters dated April 22, 2020, (ADAMS Accession No. ML20122A055), June 25, 2020 (ML20188A061),

July 21, 2020 (ML20213C031, nonpublic), July 22, 2020 (ML20213B743, nonpublic), and July 30, 2020 (ML20220A351 and ML20220A352, nonpublic). The amendment revises the Pilgrim Physical Security Plan (PSP) and revises License Condition 3.G, Physical Protection. The revised PSP integrates the existing PSPs Appendix D. Appendix D of the revised PSP provides the security requirements for the new Independent Spent Fuel Storage Installation (ISFSI) (referred to as ISFSI II) that is currently being built in the Owner Controlled Area outside of the existing Pilgrim Protected Area. contains the NRC staffs associated safety evaluation which includes "Safeguards Information" as defined by 10 CFR 73.22 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended, and must be protected accordingly. The Notice of Issuance will be included in the Commission's upcoming monthly Federal Register notice.

The NRC staff determined that the proposed modified Pilgrim PSP would continue to meet the requirements in 10 CFR 72.212(b)(9). As such, the Pilgrim PSP provides reasonable assurance that adequate protective measures can and will be taken in the occurrence of a physical security contingency at the site.

Cowan On July 1, 2020, the license amendment request; opportunity to comment, request a hearing, and petition for leave to intervene; and order imposing procedures was published in the Federal Register [Federal Register Volume 85, Number 127 (Wednesday, July 1, 2020), Pages 39592-39597]. No comments or requests were received.

The NRC staff consulted with the Commonwealth of Massachusetts on October 15, 2020 (ADAMS Accession No. ML20290A827), regarding the proposed no significant hazard determination for the proceeding. On November 16, 2020, the Commonwealth of Massachusetts responded as follows: We have no objections with additional ISFSI being included (ADAMS Accession No. ML20328A298). The NRC determined that the amendment involves no significant hazards.

The information provided in Attachment 1 of HDIs supplemental information, dated June 25, 2020 (ADAMS Accession No. ML20188A061) was provided under oath and is confirming that no significant land disturbance will occur on undisturbed land and that minimal land disturbance will occur in previously disturbed land (e.g., former parking lot area). With the supporting information the NRC staff concludes that there will be no significant construction impacts and a categorical exclusion from 10 CFR 51.22(c)(12) applies.

The amendment is effective immediately. However, spent nuclear fuel (SNF) storage on ISFSI II also requires completion of the construction of the ISFSI II and associated haul roads; the installation or modification of those security structures, systems, and components necessary to support the new ISFSI PSP. Additionally, EA-13-132 was initially issued to PNPS by letter dated July 23, 2013 (ADAMS Accession No. ML13017A321). The NRC staff notes that compliance with all the requirements will be verified during pre-operational inspection and before the PNPS will be authorized to store SNF on the PNPS ISFSI II.

In accordance with 10 CFR 2.390 of the NRC's "Agency Rules of Practice and Procedure," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS. 1. The Nuclear Regulatory Commission (the Commission or the NRC) has found that:

A. The facility will operate in conformity with the application, as supplemented, the provisions of the Act, and the rules and regulations of the Commission; B. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations set forth in 10 CFR Chapter I; C. The issuance of this amendment will not be inimical to the common defense and security, or to the health and safety of the public; and D. The issuance of this amendment is in accordance with 10 CFR Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions, of the Commissions regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by changes to Section 3.G of Renewed Facility Operating License No. DPR-35, and is hereby amended to read as follows:

The licensee shall fully implement and maintain in effect all provisions of the Commission-approved physical security, training and qualification, and safeguards contingency plans including amendments made pursuant to 10 CFR 72.212(b)(9) and to the authority of 10 CFR 50.90 and 10 CFR 50.54(p). The combined set of plans, which contain Safeguards Information protected under 10 CFR 73.21, is titled: Pilgrim Nuclear Power Station Security Plan, Training and Qualification Plan, Safeguards Contingency Plan, and Pilgrim ISFSI II Physical Security Plan, Revision 19A," supplemented by letter dated April 2, 2020 (ADAMS Accession No. ML20122A055), as supplemented by letters dated, June 25, 2020 (ML20188A061), July 21, 2020 (ML20213C031, nonpublic), July 22, 2020 (ML20213B743, nonpublic), and July 30, 2020 (ML20220A351 and ML20220A352, nonpublic).

3. This license amendment is effective immediately. However, Appendix D of the Physical Security Plan, Revision 19A, shall be implemented within 30 days of the completion of the NRC pre-operational inspection and before the Pilgrim Nuclear Power Station (PNPS) will be authorized to store spent nuclear fuel on the PNPS Independent Spent Fuel Storage Installation II.
