PART I.B -- INFORMATION NOT LOCATED OR WITHHELD FROM DISCLOSURE We did not locate any agency records responsive to your request. Note: Agencies may treat three discrete categories of law enforcement and national security records as not subject to the FOIA ("exclusions"). See 5 U.S.C. 552(c). This is a standard notification given to all requesters; it should not be taken to mean that any excluded records do, or do not, exist.
We have withheld certain information pursuant to the FOIA exemptions described, and for the reasons stated, in Part II.
Because this is an interim response to your request, you may not appeal at this time. We will notify you of your right to appeal any of the responses we have issued in response to your request when we issue our final determination.

RESPONSE TO FREEDOM OF INFORMATION ACT (FOIA) REQUEST U.S. NUCLEAR REGULATORY COMMISSION NRC -
RESPONSE NUMBER
RESPONSE
TYPE INTERIM FINAL PART I.D -- COMMENTS Signature - Freedom of Information Act Officer or Designee 2018-000103 12
In item 105, you asked for "all Memoranda of Understanding [MOU] between the NRC and any outside organization concerning access to information on dams and/or flooding." The following MOUs include provisions that may involve the sharing of dam/flooding information; these MOUs are already publicly available in ADAMS under these accession numbers:
ML062920211, ML082540354, ML011590594, ML12172A375, ML14189A307, ML16125A522, and ML16273A359.
Records with an ML accession number are publicly available in the NRC's Public Electronic Reading Room at http:www.nrc.gov/reading-rm.html. If you need assistance in obtaining these records, please contact the NRC's Public Document Room (PDR) at 301-415-4737, or 1-800-397-4209, or by email to PDR.Resource@nrc.gov.
In item 107, you asked for "all records pertaining to the NRC's decision to restrict access to flooding and dam failure information from employees not specifically assigned duties requiring the use of that information." After conferring with staff in the Office of Nuclear Reactor Regulation [NRR], the former Office of New Reactors [NRO], the Office of Nuclear Regulatory Research [RES], and the Office of the Chief Information Officer [OCIO] we are unaware of any such decision.
We have, however, included as responsive to your request any records that these offices located that touch upon this topic, including records that post-date our receipt of your request.
In item 108, you asked for "all records related to NRC guidance and policies concerning 'need-to-know' as it pertains to unclassified non-safeguards information [SUNSI]." Your request noted your specific concern with respect to any restrictions regarding the sharing of nuclear-safety information (e.g., flooding at nuclear power plants); your request excluded any guidance strictly pertaining to the limiting of access to personally identifiable information or allegation information. The records responsive to this item are enclosed.
In item 109, you asked for "all records related to the NRC decision to withdraw NRC ADAMS document ML13084A022, 03/25/2013 Slides from Meeting with Duke Energy Carolinas, LLC, Oconee Nuclear Station Units 1, 2, and 3, Concerning the Flooding Hazard Reevaluation Report, from the public domain. Specifically, GAP seeks the affidavit required under 10 CFR 2.390(b)(1). If the NRC waived the affidavit requirements, then GAP seeks any and all records pertaining to the NRC decision to withdraw ML13084A022 from the public domain." The only records responsive to this item are the same records responsive to items 39, 40, and 42 of your request, which we addressed in our interim responses #1 and #5 to your request.
We appreciate your continued patience.
