IDAHO STATE UNIVERSITY-SPECIAL NUCLEAR MATERIALS LICENSE NUMBER 1373, AMENDMENT REQUEST TO UPDATE UNIVERSITY OFFICIALS ROSTER

Dear Dr. Lybecker:

This is in response to your submittal dated July 14, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20197A004), as supplemented by your letter dated August 25, 2020 (ADAMS Accession No. ML20268A202). In your July 14, 2020, submittal you requested that the U.S. Nuclear Regulatory Commission (NRC) amend Special Nuclear Materials License No. 1373 (SNM-1373), for the Idaho State University (ISU), by updating the roster of ISU officials to include you as the new Vice President for Research, and Mr. Jonathan Scott as Reactor Supervisor in Training. In your August 25, 2020, letter you provided the qualifications for you and Mr. Scott.

The NRC staff evaluated yours, as well as Mr. Scotts, qualifications against the criteria established in the September 26, 2016, updated attachment IV of ISUs license application (ADAMS Accession No. ML16279A282), which establishes the minimum qualifications for the Responsible University Officer (currently the Vice President for Research), and the Reactor Supervisor as follows:

A. Responsible University Officer-currently the Vice President for Research and Dean of the Graduate School

1. PhD or equivalent education in a scientific/engineering/technology field, and
2. At least 5 years of supervisory/administrative experience.

B. Reactor Supervisor

1. Bachelor of Science in an engineering or physical science field.
2. At least 2 years of experience related to nuclear reactor operations (need not have power reactor experience).
3. Pass the requirements, or equivalent, for having a Reactor Operator License, and obtain a Senior Reactor Operator License within one year of qualifying for the Reactor Operator License.
4. Must maintain certification as a Senior Reactor Operator.

D. Lybecker 2 In the August 25, 2020, supplemental information provided in response to the NRC staff request for additional information dated August 13, 2020 (ADAMS Accession No. ML20225A041), you stated that you possess more than 5 years of administrative experience, and that you hold a Doctor of Philosophy degree (PhD) in political science with an emphasis in environmental policy. The NRC staff evaluated this information, and determined that you meet the requirement for administrative experience, but determined that the PhD in political science does not meet the requirement for education in a scientific/engineering/technology field. However, if you have any additional information regarding your scientific background that you believe qualifies you for the position that you would like the NRC staff to review, please provide it to us for further evaluation within 30 days from the date of this letter. Alternatively, submit the name and supporting information for another individual that meets both requirements for evaluation.

The NRC staff evaluated the qualifications of Mr. Scott against the criteria established in the September 26, 2016, updated attachment IV of ISUs license application, and determined that Mr. Scott meets all of the requirements for the reactor supervisor in training position and can be included in the roster of ISU officials. Therefore, we request that you revise your license amendment request so we can proceed to amend the SNM-1373 license to add Mr. Scott to the roster.

In accordance with 10 CFR Section 2.390 of the NRC Agency Rules of Practice and Procedures, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room, or from ADAMS.
