NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-369/89-09 AND-50-370/89-09)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

D. LThompson _ on February 20-24, 1989.

The inspection included a review l of

.

activities authorized .for your McGuire facility.

At the -conclusion of. the

inspection, the findings were discussed with those members of your staff

identified in the enclosed Inspection Report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and' . representative records, interviews with personnel, and observation of

activities in progress.

The -inspection findings indicate that certain activities appeared to violate

NRC requirements'.

The violations, references to pertinent requirements, and

elements to be included in your response are described in the enclosed Notice

of Violation.

In addition to the need for corrective action regarding the specific matters-

identified in tha ' enclosed Notice, Mr. D. McGuire, Chief, Physical Sacurity

Section; and Mr. M. Shymlock, Chief, Reactor Projects expressed NRC's concerns

~

to' Mr. T. L. McConnel Station Manager about the areas discussed. during the

inspector's exit and specifically the numerous and continued violations in the

Access Control Program.

Consequently, your response should describe those

particular actions .taken or planned to improve the effectiveness of your

program.

In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and

security measures are exempt from public disclosure. Therefore, the enclosures

to this letter with the exception of the report cover page, which presents a

,

nonexempt summary, will n_ot be placed in the NRC Public Document Ro m.
