Dear Mr. Chilk:
On May 24, 1989, the Nuclear Regulatory Commission published a notice in the Federal Register concerning the proposed amendment of Combustion Engineering's Special Nuclear Materials License No. SNM-33.

Crnbustion Engineering has received a copy of a w::morandum, dated June 19, 1989, from a Missouri State Senator, Jeremiah N. Nixon, to the NRC Executive Director of Operations concerning the proposed amendment.
If and when a copy of the
-r..orandum is received by the Office of the Secretary, it should be rejected by the Secretary pursuant to 10 C.F.R. SS 2.1261 and 2.772(i) since -- as discussed in the enclosed " Applicant's Answer to Senator Nixon's Memorandum" (the " Answer") -- it fails to comply with the minimum requirements for a hearing request under 10 C.F.R. Part 2, Subpart L.
In the event that you do not reject Senator Nixon's memorandum, please consider the enclosed Answer as C-E's legal answer pursuant to 10 C.F.R. S 2.1205(f).
