On May 24, 1989, the Nuclear Regulatory Commission published a notice in the Federal Register concerning the
. proposed amendment of Combustion Engineering's Special' Nuclear Materials License No. SNM-33.
54 Fed. Reg. 22,510.
Combustion Engineering has received a copy of a letter, usted June 22, 1989, from Martha Dodson, Karen Sisk, and the Coalition for the Environment, to the NRC Executive Director of Operations concerning the proposed amendment.
If and when a copy of the letter is received by the Office of the Secretary, it should be rejected by the Secretary pursuant '.o 10 C.F.R. SS 2.1261 and 2.772(1) since -- as discussed in the enclosed
" Applicant's Answer to June 22, 1989 Letter Regarding the Hematite Fuel Fabrication Facility" (the " Answer") -- it fails to comply with the minimum requirements for a hearing request under j.
10 C.F.R. Part 2, Subpart L.
In the event that you do not reject the. letter, please consider the enclosed Answer as C-E's legal cnswer pursuant to 10 C.F.R. S 2.1205(f).
