NOTICE OF VIOLATION Commonwealth Edison Company Docket No. 50-456 As a result of the inspection conducted from July 30 through September 16, 1989, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1989), the following violation was identified:

10 CFR 50.72, paragraph (b)(1)(ii), requires a licensee to notify the NRC via the Emergency Notification System within one hour for "Any event or condition during operation that results in the condition of the nuclear power plant, including its principal safety barriers, being seriously degraded. . . ."

enatrary to the above, on September 2,1989, at 1:00 a.m., during testing of main steam safety valve IMS017C, the safety valve stuck open. Although an effortwasmadetoclosethevalve,itremginedopenatvariouspositionsfor approximately 42 minutes, resulting in a 5 F reduction in reactor coolant temperature. This condition is considered to be a degradation of a principal safety barrier. The ENS notification was made at 7:55 a.m., about six hours late.

This is a Severity Level IV violation (Supplement I). (50-456/89022-02(DRP)

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) the corrective actions that have been taken and the results achieved; (2) the corrective actions that will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
