Attached is the South Carolina Electric & Gas Company (SCE&G) response to the Notice of. Violation (NOV) dated August 18, 1989. Attachment 1 to this letter is the SCELG " Response to Notice of Violation" (see 10 CFR 2.201).

SCE&G disagrees that a violation occurred as described in paragraph 2b of the Inspection Report. As indicated during the exit meeting, SCE&G does not agree that the' violation described in the Inspection Report occurred. In sum, SC&EG L believes that there has been misinterpretation of subsection IWV-3300 of the.

ASME Code in relation to testing of valves with remote position indicators.

I. RESTATEMENT 0F VIOLATION i

-Technical Specification 4.0.5 requires inservice testing of ASME Code l Class 1, 2, and 3 pumps and valves in accordance with Section XI of the ASME Boiler and Pressure Vessel Code and applicable Addenda. .The licensee'is committed to inservice testing in accordance with the 1980 Edition of the Code and Winter Addenda.

Section XI, Subsection IWV-3300 of the 1980 Code, requires valves with ,

remote position indicators to be observed at least once every 2 years i to verify that valve operation is accurately indicated. j Contrary to the above, verification of remote position indicators at.  !

the remote shutdown panels was not being performed.  !

II. SCE&G POSITION ON VIOLATION l SCE&G denies the violation. l l

1 III. BASIS FOR SCE&G POSITION This violation is based.on Subsection IWV-3300 of the 1980 ASME Code j that requires that valves with remote position indicators be observed

'I at least once every two years to verify that valve operation is accurately indicated. Contrary to the violation, SCE&G satisfies this ,

requirement in its Inservice Test Program (IST) by verifying accurate position indication at the main control board. . SCE&G performs a 1 periodic channel check of the shutdown panel instrumentation; however, '

the IST need not call for verification of the remote position indication every two years at the shutdown panel. )

SCE&G's compliance with Section XI, Subsection IWV-3300 of the 1980 ASME Code is demonstrated by a recent interpr'tation addressing this .

precise issue. Under the recent interpreta+ .an, Subsection IWV-3300 l requires that "for valves having remote position indication at multiple  !

locations (such as in the control room and also on a remote shutdown l panel...)...only the remote position indicator at the location utilized '

in exercising the valve (IWV-3413)" need be verified. (Interpretation XI-1-89-10, issued November 14, 1988; copy attached.) The licensee's IST meets this interpretation and therefore complies with the intent of l Section XI, Subsection IWV-3300 of the 1980 Code and complies with i Technical Specification 4.0.5. )
