Statement in Reply'to Notice of Violation This refers to your letter dated February 6,1989, in response to our letter dated January 18, 1989. We have reviewed the information provided in your re-sponse.to the' Notice ~of Violation, dated January 18, 1989, as well as the in-

formation you'provided during an enforcement conference conducted with you by
.the NRC in the Region I office on September 7, 1988.
. As defined in 10 CFR Part 2, Appendix C the term willfulness " embraces a spectrum of-violations ranging from deliberate intent te violate or falsify to and including careless disregard.for requirements." After reviewing your concern we find that the term willful, as defined above, was properly applied in-this case..'However, we conclude the records you destroyed were not an att-empt to hide the Safety' Limit Viol' tion We also note your full and candid par-a ticipation in both the Stier and~NRC investigation of the matter.
You stated that during the' time since the. event on September 11, 1987, you have had an opportunity"to reflect on your past conduct.
For reasons more fully set forth in your. response, you do not think there will be a recurrence of such conduct
~
should you be permitted to once again hold an operator license. You indicate you are now prepared to accept ~the responsibility associated with holding.an operating license, and indeed state that because of the events of' September 11,1987, would be a t'etter licensed operator than before.
We reiterate that the destruction of plant records as well as the failure to promptly report the record destruction to your management was a serious dere-liction of duty, and will remain a part of your personal records maintained by the NRC. However, in light of the corrective steps you' set forth in your February 6, 1989 response to the Notice of Violation and your presentation dur~
R ing the enforcement conference, we do not consider your actions surrounding the September 11,19C7 ' Safety Limit Violation to be sufficient to deny a license if you apply in the future and otherwise meet the requirements of 10 CFR Part 55
- for issuance of an operator's or senior operator's license.
