NOTICE OF VIOLATION

(NRC INSPECTION REPORT N05. 50-327/89-15 AND 50-328/89-15)

This refers to the Nuclear Regulatory Commission (NRC) routine monthly

inspection conducted by K. Jenison from May 6,1989 thru June 5,1989.

At the

i

conclusion of the inspection, the findings were discussed with those members of

l

your staff identified in the enclosed inspection report.

'

Areas examined during the inspection are identified in the report.

These areas

included operational safety verification, refueling activities, and maintenance

and surveillance activities.

Within these areas, the inspection consisted of

selective examinations of procedures and representative records, interviews

with personnel, and observation of activities in progress,

The inspection findings indicate that certain activities appear to violate NRC

requi rements.

The identified violations involved a failure to control work

activities and a failure to have procedures for controlling Thermal Power

within license limits during steady state operation.

Please include in your

response - to Violation 327,328/89-15-02 a disc sion of the associated

weaknesses identified in the inspection ienort and what actions you have taken

concerning the weakness.

The violations, references to pertinent requirements, and

elements to be included in your response are described in the enclosed

Notice of Violation.

In addition, three violations described in the enclosed Inspection Report are

under consideration for escalated enforcement action.

These violations

involve inadequate reviews pursuant to 10 CFR 50.59, failure to follow

procedures, and failure to meet Technical Specification action statements.

Accordingly, no Notice of Violation for these activities is being issued at

this time.

However, please be advised that the number and chara-terization of

violations described in the enclosed Inspection Report may change as a result

of further NRC review.

An Enforcement Conference to discuss these violations

has been scheduled for June 29, 1989, at the NRC headquarters located at White

Flint Building in Rockville, Maryland.

You will be advised of the results of

our deliberations on this matter by separate correspondence.

Several apparent weaknesses were observed in your safety

evaluation process which warrants additior>al NRC review.

This item will be

addressed during future inspections.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter, its enclosures,

and any reply will be placed in the NRC's Public Document Room..

The responses directed by this letter and its enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the
