.e, Executive Director'for Operations March 2, 1989 Mr.. Victor Stello, Jr.
? United States Nuclear Regulatory Commission Washington, D.C.

'(FAXED) & Certified Thomas J.
Saporito, Jr.
1202 Sioux Street Jupiter, Florida 33458
~(407) 747-8873 re: Title (10) Code of Federal Regulations Part (2.206)
Please be advised and officially informed as this letter represents a formal request to your office in regards to your licensee Florida Power Light Company, (Turkey Point Nuclear Station), located in Homestead, Florida for actions by your office as specified below and pursuant to (2.202)'of the Federal Code.
Specific Request:
I hereby officially.and formally request that your office immediately suspend and revoke the Operating Licenses's (DPR-31 & DPR-41) of the Turkey' Point Nuclear Station owned and operated by the Florida Power &'
Light Company in Miami Florida.
Basis and Justification:
Febuary 1989, Turkey Point' Nuclear Unit #3 tripped 0FF-LINE as a direct result of. a poorly written procedure being performed by Instrument.
Control Specialists at the plant.
Procedure problems at the Turkey Point Nuclear Station have consistently been identified by the Nuclear Regulatory Commission and others as being a significant contributing factor for the plant's poor performance and concern for the ability of the plant operators to properly and safely control and operate the Nuclear Reactors and leaves reasonable doubt that the reactors can be shut down should an event occur which would require such action.
The. Site Vice President at-the Turkey Point Nuclear Station (John Odom),
lied in a
Federal Court Hearing (89-ERA-07 & 89-ERA-17) in Febuary 1989 about information he received from the Nuclear Regulatory Commission personnel regarding the existance of (immediate nuclear safety concerns identified by Mr.
Saporito) and furthermore, he testified that the Nuclear Regulatory Commission's personnel were not competent to determine nuclear safety concerns.
Termination of the Management on Shift (MOS) program as confirmed by a January 20, 1989 letter to Florida Power & Light (W.F.Conway) from the Nuclear Regulatory Commission Region II relating to the NRC Order EA 87-85 dated October 19, 1987.
At the aforementioned Federal Court Hearing, Florida Power & Light management personnel testified that this program was a means for employees to surface safety concerns.
Testimony at the aforementioned Federal Court Hearing by a Florida Power Light Supervisor (Gregg Verhoeven),
collaborated previous testimony which I
had given to the Nuclear Regulatory Commission's Region II Office of Investigation inspectors on January 12, 1989, of willful _1 f_a_1_s i f i cat i on of Safety Related_ plant documentation at the Tur_ key Point Station._

' Basis and Justification:
Mr. Richard Colston informed me that supervisor (John Halverson) at the Turkey Point Nuclear Plant is harassing and discriminating against him because of his participation as a witness in the aforementioned Federal Court Hearing. This event further illustrates actions by Florida Power Light to enhance the present severe chilling effect at the plant and thereby harbor themselves free of employees identifying safety' concerns to the Nuclear Regulatory Commission and therefore the Health and
' Safety of the Public could be adversely affected.
Mr.
Ken Clark of the Nuclear Regulatory Commission's Region II office confirmed to the South Dado News Leader reporter 'Ms. Lynda Jennings' that "we have received numerous' allegations of concerns at the Turkey Point Nuclear Plant which potentially could affect safety." Clark said we have received a number of allegations most of which we were already aware of...we were aware of 80% of the (safety concerns).
==
Conclusion:==
My understanding of (10CFR2.266) identifies that reasonable doubt for the Health and Safety of the Public justifies the suspention and revoking of a
Nuclear Plant's Operating License.
I submit that (reasonable doubt) has been documented to the Nuclear Regulatory Commission.as evidenced by (10CFR2.206) documents filed on December 21,
- 1988, January 13,
- 1989, January 30, 1989, Febuary 7, 1989, and this document itself.
Therefore, in the interest for the Health and Safety of the Public, I_ r e.g u e s t that the Nuclear Regulatory Commissioners take immediate act_ ions to cause the suspention and revoking of the afpr_ementioned Sp_erating licenses.
1 Sincerely:
M Thomas J.
Saporito, Jr.
