1 Please be advised and officially informed as this letter represents I

formal notification to your office regarding receipt of the Jan. 30, 1989 letter and the RECEIPT OF PETITION FOR DIRECTOR'S DECISION UNDER 10 CFR 2.206 regarding Turkey Point's Operating Licenses DPR 31 & 41.

The aforementioned letter and petition state that documents which I have filed with the Nuclear Regulatory Commission "do not indicate'any immediate need to keep the Turkey Point Plant Units 3 & 4 reactors shut down.

Our basis for this position is that your concerns have not identified any new information which is not already being addressed by the licensee and the staff, or which we were not already aware of."

Pursuant to 10 CFR 2.206 paragraphs A,B,C, the Nuclear Regulatory i

Commission as represented by Mr. Thomas E.

Murley has not proceeded within the guidelines of the Federal Code. Furthermore, the Nuclear Regulatory-Commission's basis for action as documented in the aforementioned 1/30/89 letter & petition by-Mr. Murley are not correct.

j In the interest for the Health and Safety of the Public, I hereby officially. and formally request that you take immediate actions to cause my voice to be heard before the United States-Nuclear Regulatory Commissioners' as I

intend to demonstrate to the commissioners

' reasonable cause' for the immediate causpention of tna Turkey Point-Operating Licenses and determination for the revoking-of the Turkey Point. Operating Licenses (DPR 31 &.DPR 41).

I-am not satisfied with the Nuclear Regulatory Commission's lack of immediate action and the limited and improper regulatory responce to my 10 CFR 2.206 requests in regards to the Turkey Point Station, and therefore in the interest for the Health and Safety of the Public, a formal request will be made upon the Nuclear Regulatory Commission's Office of Internal Auditing for resolution of.my concerns relating to the conduct and behaviour of Nuclear Regulatory Commission's personnel in Washington. D.C. and at the Turkey Point Station.
