SAFETY EVALUATION REPORT, LICENSE AMENDMENT APPLICATION DATED APRIL 1, 1989, RE PROPOSED REVISIONS TO AUTHORIZED POSSESSION LIMITS, FINANCIAL ASSURANCE FOR DECOMMISSIONING, AND RADIOLOGICAL CONTINGENCY PLAN Bcckground By letter dated October 20, 1988, NRC notified ANF that based on the authorized possession limits, SGTR staff had erred by instructing the licensee to submit a new Fundamental Nuclear Material Control Plan as required by 10 CFR 74.31(b)(1). To correct the error, staff presented ANF with a choice of either (1) reverting back to the 10 CFR Part 70 safeguards requirement or (2) modifying the possession limits so as to be subject to 10 CFR 74.31. Accordingly, in the subject application submitted by letter dated March 30, 1989, ANF has chosen option (2) and proposed a revision to the possession limits.

In addition, ANF has proposed changes to the license regarding financial assurance for decommis-sioning and a revised Radiological Contingency Plan. By letter dated May 24, 1989, ANF submitted the revised Radiological Contingency Plan dated January 31, 1989.

Discussion Possession Limits ANF is currently authorized to possess a total quantity of 20,000 kilograms of uranium-235. Based on the NRC staff's recommendation, ANF proposes. to decrease their possession limit for uranium enriched from 10 to 19.99 w/o in' the U-235 1sotope to be subject to the requirements of 10 CFR 74.31 and remain in the Category III classification for material control and accounting purposes. The staff has determined that the present radiological and nuclear criticality safety programs are adequate to support these changes. To clarify the requested materials, forms, and quantities of special nuclear material, the staff recommends the following revision for Conditions 6, 7, and 8:

Decommissioning Plan In the existing license, ANF incorporates a letter from the President of Siemens Capital Corporation which states that at the time of decommissioning, funds will be available for the decontamination and decommissioning of the ANF 4

fuel fabrication facility. ANF has proposed a revision to the license that states that the letter is submitted in compliance with the 10 CFR 70.25 requirement for financial assurance of decommissioning. However, ANF has not submitted a decommissioning funding plan or a certification of financial assurance for decommissioning as required in 10 CFR 70.25. Because the exi' sting comitment does not satisfy the requirements of the regulation, the staff reconmends the following condition to exclude the proposed revision to the decommissioning plan:

Radiological Contingency Plan (RCP)

In the revised RCP, ANF has incorporated response procedures for chemical emergencies replaced Exxon Nuclear Company Inc. with Advanced Nut. lear Fuels Corporation to reflect the licensee's new na,me, an,d updated the Plan. ANF proposes to incorporate into the license the revised Plan by referencing its date.

The staff has reviewed the revised RCP and agrees with ANF's conclusion that i

the changes do not decrease the response effectiveness of the Plan.

Advanced Nuclear Fuels Corporation 3 August 11, 1989 Conclusion / Recommendation Based on the discussion, the staff concludes that the proposed revisions to the possession limits and Radiological Contingency Plan are acceptable and do not adversely affect public health and safety or the environment. Therefore, the staff recommends approval of the application subject to the additional condition developed by the staff.

The Region Y Section Chief has no objection to this proposed action.
